Ե՞րբ են փոխհատուցվելու ՀՀ քաղաքացիներից հակասահմանադրական ճանապարհով գանձված գումարները. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է. ՀՀ Սահմանադրական դատարանը երեկ հակասահմանադրական ճանաչեց առողջապահության նախարար Անահիտ Ավանեսյանի հրամանի այն հատվածը, որով նախատեսվում էր՝ աշխատող քաղաքացիները որոշակի պարբերականությամբ պետք է իրականացնեն կորոնավիրուսի դեմ ՊՇՌ թեստ՝ իրենց հաշվին:

Այս հարցը ՍԴ-ում վիճարկվում էր ԱԺ ընդդիմադիր «Հայաստան» խմբակցության պատգամավորների բողոքի հիման։ Օրենքը սահմանում էր, որ գործատուն արդեն օրենքի ուժով կարող է ՊՇՌ թեստի սերտիֆիկատ չներկայացնող չպատվաստված աշխատակցին ազատել աշխատանքից։ Նկատենք՝ Հայաստանն առանց այն էլ այս պահին պատվաստման շատ ցածր ցուցանիշ ունի. ամբողջությամբ պատվաստվել է միայն երկրի բնակչության 14 տոկոսը։ Եվ այս տոկոսն էլ, փաստորեն, ապահովվել է հենց այս հակասահմանադրական որոշման շնորհիվ։ Իսկ ո՞վ պետք է հիմա վերադարձնի քաղաքացիների գումարները։

Այս հարցի պատասխանը փորձել ենք ստանալ Փաստաբանների պալատի նախկին նախագահ Արա Զոհրաբյանից։ Նա նշեց. «Այդ հարցի պատասխանն ավելի հստակ կարելի է տալ Սահմանադրական դատարանի որոշմանը ծանոթանալուց հետո: Այն, որ պետությունն ամեն ինչ անելու է, որ պատասխանատվությունից խուսափի, դա փաստ է: Դեկտեմբերի 14-ին կատարած հարցմանս, թե պետությունը քաղաքացիների վնասը հատուցելու է արդյոք, երբ պարզվի, որ տուժել են պատվաստանյութերից, պատասխանել են, որ պատվաստումները կատարվում են կամավոր: Մեր թիմը փորձելու է նաեւ իրավական ճանապարհը գտնել քաղաքացիների վնասի հատուցման իրավունքները պաշտպանելու համար»:

Այսպիսով, կարեւոր հարցի պատասխանը դեռ պարզ չէ. ե՞րբ են փոխհատուցվելու ՀՀ քաղաքացիներից հակասահմանադրական ճանապարհով գանձված գումարները:
