Ֆեյսբուքում գրված խոսքը հրապարակայի՞ն է

Օրեր առաջ փաստաբան Երվանդ Վարոսյանը Facebook-ի իր էջում արված գրառման համար խիստ նկատողություն ստացավ Փաստաբանների պալատի կողմից, ինչը բավականին բուռն արձագանք ստացավ համացանցում: Հիշեցնենք, որ նկատողության առիթը հետևյալ գրառումն էր. «Կարելի է միայն հպարտանալ նրանով, որ քո դեմ որոշ չորքոտանիներ ճղճիմ հոդվածներ են պատվիրում (հատկապես պնդուկ ուղեղով չորքոտանիները): Դա նշանակում է, որ դու ճիշտ ուղու վրա ես»: Իսկ թե որքան իրավաչափ էր նկատողությունը և թե արդյոք Facebook-ում արված գրառումը կարելի է ընդունել որպես հրապարակային խոսք, փորձեցինք պարզել իրավաբան Արա Ղազարյանից:
Past.am-ի հետ զրույցում նա վստահեցրեց, որ Facebook-ում արված հայտարարությունը հրապարակային խոսք է, և դրա վերաբերյալ կան բազմաթիվ դատական ակտեր: «Եթե գրառումը կարդում է երկու հոգի, այսինքն՝ եթե երրորդ մարդը կա և հաղորդակցվում է, արդեն գրված խոսքը հրապարակային է: Facebook-ում ասված խոսքը նույնն է, ինչ դուք այն ասեք փողոցում կանգնած: Facebook-ը հրապարակային տիրույթ է, որտեղ պետք է զսպվածություն ցուցաբերվի»,- մեկնաբանեց Ղազարյանը՝ նշելով, որ դրան պետք է հետևեն հատկապես մարդիկ, ովքեր գործի բերումով հանրության աչքի առջև են:
Ըստ նրա՝ ինչ վերաբերվում է տույժ կիրառելուն, ապա դա կախված է փաստերի վերլուծությունից: «Փաստերի գնահատումն այլ բան է, իսկ սկզբունքը՝ այլ բան: Սկզբունքի հիման վրա կատարվում է փաստերի գնահատում: Եթե վերցնենք երեք մարդ և ասենք՝ գնահատեք փաստերը, ապա 3-ն էլ կարող են տարբեր ձևով գնահատել, բայց սկզբունքը կլինի 1-ը: Facebook-ում ասված խոսքը հրապարակային է»,- մեկնաբանեց Արա Ղազարյանը:
