ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության հատկապես կարևոր գործերի քննության վարչությունում քննվող քրեական գործի նախաքննությամբ ձեռք բերված ապացույցների բազմակողմանի, լրիվ և օբյեկտիվ հետազոտմամբ, դրանք իրենց համակցության մեջ վերլուծությամբ և համատեղ գնահատմամբ պարզվել է, որ Գ.Գ.-ն, 2021 թվականի նոյեմբերի 16-ին իրականացնելով ՀՀ ՊՆ N զորամասի գումարտակի հրամանատարի պաշտոնակատարի պարտականությունները, նշանակված լինելով որպես նույն գումարտակի պահպանությանը հանձնված պաշտպանության շրջանի պատասխանատու և ընդգրկված լինելով մարտական հերթապահությունում գումարտակի պահպանությանը հանձնված տեղամասում, իսկ Ս.Մ.-ն, նույն ժամանակ ընդգրկված լինելով մարտական հերթապահությունում և իրականացնելով մարտական դիրքի դիտորդի պարտականությունները, խախտել են «Հայաստանի Հանրապետության զինված ուժերի ներքին ծառայության կանոնագիրքը հաստատելու մասին» ՀՀ օրենքով, ՀՀ պաշտպանության նախարարի համապատասխան հրամանով հաստատված մարտական հերթապահության կազմակերպման և իրականացման կանոնադրությամբ սահմանված կանոնները, որպիսի գործողություններն առաջացրել են ծանր հետևանքներ. Ադրբեջանի զինված ուժերի զինծառայողները ներխուժել են ՀՀ ինքնիշխան տարածք՝ մարտական դիրք, դիրքում մնացած 13 զինծառայողներ գերեվարվել են հակառակորդի կողմից, մարտական դիրքն անցել է հակառակորդի վերահսկողության տակ, գերեվարված 13 զինծառայողներից Տ.Ս.-ի և Ա.Գ.-ի սպանված դիերը համապատասխանաբար նոյեմբերի 17-ին և 19-ին փոխանցվել են հայկական կողմին, դիրքում մնացած 11 զինծառայողների գտնվելու վայրը մինչև օրս անհայտ է։

2021թ. նոյեմբերի 22-ին և 23-ին, Գ.Գ.-ն և Ս.Մ.-ն ՀՀ քրեական օրենսգրքի 365-րդ հոդվածի 3-րդ մասով նախատեսված հանցավոր արարք կատարելու կասկածանքով ձերբակալվել են։ Նոյեմբերի 24-ին վերջիններիս մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 365-րդ հոդվածի 3-րդ մասով և որպես խափանման միջոց է կիրառվել կալանավորումը։
