ՄԻԵԴ-ը կարող է միջանկյալ միջոցներ կիրառել Ադրբեջանի դեմ՝ գերեվարված զինծառայողների իրավունքների վերաբերյալ ՀՀ դիմումի հիման վրա
INTERNATIONAL NEWSՄարդու իրավունքների եվրոպական դատարանը (ՄԻԵԴ) կարող է միջանկյալ միջոցներ ձեռնարկել ՀՀ -ի բողոքի առնչությամբ, որով Հայաստանը պահանջում է պաշտպանել նոյեմբերի 16-ի միջադեպի ժամանակ Ադրբեջանի կողմից գերեվարված իր զինծառայողների իրավունքները։ Այս մասին ուրբաթ օրը ՏԱՍՍ-ին հայտնել են ՄԻԵԴ-ի մամուլի ծառայությունից։
«Դատարանը ստացել է 39 կանոնի կիրառման դիմումը 33 հայ ենթադրյալ գերիների նկատմամբ։ 28-ը ներառված է ՀՀ կառավարության կողմից միջպետական դիմումի մեջ, 5-ը՝ անհատական բողոքներում՝ ենթադրյալ գերիների հարազատների կողմից ուղարկված»,- ասվում է ՏԱՍՍ-ին ուղղված դատարանի պատասխանում։
Մամուլի ծառայությունը նշում է, որ հինգ անհատական բողոքներով «դատարանը կիրառել է 39-րդ հոդվածի դրույթները»։ «Մնացած 28 ենթադրյալ բանտարկյալների առնչությամբ՝ ի դեմս Հայաստանի կառավարության, դատարանը հետաձգեց քննարկումը և տեղեկատվություն պահանջեց Ադրբեջանի և Հայաստանի կառավարություններից»,- ասվում է հայտարարության մեջ։
Դատարանի կանոնակարգի 39-րդ կանոնի համաձայն՝ ՄԻԵԴ-ը կարող է միջանկյալ միջոցներ կիրառել Մարդու իրավունքների եվրոպական կոնվենցիայի մասնակից ցանկացած պետության նկատմամբ։ Միջանկյալ միջոցները անհետաձգելի միջոցներ են, որոնք սահմանված դատական պրակտիկայի համաձայն կիրառվում են միայն անուղղելի վնաս պատճառելու իրական ռիսկի դեպքում։
Հիշեցնենք, որ Հայաստանի Հանրապետությունը դիմել է Մարդու իրավունքների եվրոպական դատարան՝ 2021թ. նոյեմբերի 16-ին Ադրբեջանի կողմից ՀՀ ինքնիշխան տարածքում սանձազերծված ագրեսիվ գործողությունների ընթացքում գերեվարված հայ զինծառայողների հիմնարար իրավունքների ապահովման պահանջով։
