Արմեն Չարչյանի անձեռնմխելիության հաղթահարման ընթացակարգերի բացակայության հարցով ՍԴ դիմելու միջնորդությունը մերժվեց
POLITICSԵրեւանի ընդհանուր իրավասության դատարանը՝ դատավոր Վահե Միսակյանի նախագահությամբ, այսօր՝ նոյեմբերի 23-ին, «Հայաստան» խմբակցության պատգամավոր, «Իզմիրլյան» ԲԿ նախկին տնօրեն Արմեն Չարչյանի անձեռնմխելիության հաղթահարման ընթացակարգերի բացակայության հարցով ՍԴ դիմելու մասին միջնորդությունը մերժեց։
Նախորդ դատական նիստին Արմեն Չարչյանի պաշտպան Էրիկ Ալեքսանյանը միջնորդություն էր ներկայացրել՝ ՀՀ քրեական դատավարության օրենսգրքի 31-րդ եւ 35-րդ հոդվածների սահմանադրականության հարցով ՍԴ դիմելու մասին՝ Արմեն Չարչյանի պատգամավորական անձեռնմխելիության հաղթահարման ընթացակարգերի բացակայության հիմքով։
Ըստ պաշտպանի՝ Չարչյանն ունի պատգամավորական անձեռնմխելիություն, եւ , որ պատգամավորի նկատմամբ քրեական հետապնդում կարող է հարուցվել միայն ԱԺ համաձայնությամբ, ԱԺ պատգամավորն առանց ԱԺ համաձայնության չի կարող զրկվել ազատությունից, սակայն գործող կարգավորումները չի նախատեսում արդեն իսկ հարուցված քրեական հետապնդման շարունակության համաձայնություն ստանալու կառուցակարգ, ընթացակարգ, միեւնույն ժամանակ, սահմանադրական նորմը նախատեսում է բոլոր իրավիճակների վրա տարածվող անձնական անձեռնմխելիություն։
Նշենք, որ այս ընթացքում Արմեն Չարչյանի առողջական վիճակը պարբերաբար վատանում է, սակայն նա շարունակում է մնալ կալանքի տակ:
Ավելի վաղ NEWS.am-ը հայտնել էր, որ ՀՀ վերաքննիչ քրեական դատարանն Չարչյանին գրավի դիմաց ազատ արձակելու որոշման դեմ դատախազության բողոքը բավարարել էր։ Դատարանի որոշումից հետո Արմեն Չարչյանը սեփական նախաձեռնությամբ գնացել էր քրեակատարողական հիմնարկ, ապա՝ կալանավորվել, ապա Չարչյանի առողջական վիճակը վատթարացել էր, ու նա տեղափոխվել է քաղաքացիական հիվանդանոց։ Չարչյանը օգոստոսի 24-ին տարել է սուր ինֆակտ, ունի ծանր շաքարային դիաբետ եւ ընդունում 92 միավոր ինսուլին, ինչն ուղղակի անհամատեղելի է կալանքի հետ, եւ այս անհամատեղելիությունը հաստատվում է Կառավարության 825Ն որոշմամբ:
Չարչյանին մեղադրանք է առաջադրվել՝ ՀՀ ՔՕ 154.2-րդ հոդվածի 4-րդ մասի 2-դ կետի հատկանիշներով (ընտրողներին կաշառք տալը, կաշառք ստանալը, ընտրությունների ժամանակ բարեգործության արգելքի խախտումը կամ ընտրողի ազատ կամքի իրականացմանը խոչընդոտելը):
