ԱՀ Հին Թաղեր գյուղում մարտական հերթապահություն իրականացրած գումարտակի հրամանատարը կալանավորվել է․ ՔԿ

ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության հատկապես կարևոր գործերի քննության վարչությունում քննվող քրեական գործի շրջանակներում իրականացված մեծածավալ քննչական և այլ դատավարական գործողությունների արդյունքում ձեռք բերված փաստական տվյալների հիման վրա պարզվել է, որ Ջ.Մ.-ն, զբաղեցնելով հրաձգային գումարտակի հրամանատարի պաշտոնը և հանդիսանալով իր ենթակա անձնակազմի պետը, 2020թ. նոյեմբերի 9-ին եռակողմ համաձայնագրի կնքումից հետո հրաման է ստացել մարտական հերթապահություն կատարելով ապահովել Արցախի Հանրապետության Հադրութի շրջանի Հին Թաղեր տեղամասի արևելյան սահմանի թվով 12 մարտական դիրքերի անվտանգությունը, սակայն 2020թ.  դեկտեմբերի 11-ից 12-ն ընկած ժամանակահատվածում տեղի ունեցած մարտական գործողությունների ընթացքում ցուցաբերել է պաշտոնեական անփութություն, որպիսի գործողություններն առաջացրել են ծանր հետևանքներ՝ Հադրութի շրջանի Հին Թաղեր տեղամասի արևելյան սահմանի 12 մարտական դիրքերն անցել են թշնամու վերահսկողության տակ, վերջինիս ենթակայության ներքո գտնվող թիվ N մարտական դիրքում տեղակայված անձնակազմի զինծառայողները հայտնվել են շրջափակման մեջ, որից ինը զինծառայողներ զոհվել են, երկուսը՝ գերեվարվել: Այս մասին հայտնում են ՀՀ քննչական կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժնից։

Հիշյալ հրամանատարին դեռևս 2021թ. ապրիլի 30-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 376-րդ հոդվածի 3-րդ մասով և միջնորդություն էր ներկայացվել Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարան՝ նրա նկատմամբ կալանավորումը որպես խափանման միջոց ընտրելու վերաբերյալ, որը 2021թ. մայիսի 1-ի որոշմամբ մերժվել էր։

Քրեական գործով մինչդատական քրեական վարույթի օրինականության նկատմամբ հսկողություն իրականացնող դատախազի կողմից նշված որոշումը բողոքարկվել է ՀՀ վերաքննիչ քրեական դատարան, որը դատարանի կողմից բավարարվել է, և գործն ուղարկվել Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարան` նոր քննության:

Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանը 2021թ. նոյեմբերի 8-ին բավարարել է վարույթն իրականացնող մարմնի միջնորդությունը, և մեղադրյալ Ջ.Մ-ի նկատմամբ որպես խափանման միջոց ընտրվել է կալանավորումը:
