Ադրբեջանում Կարենը ենթարկվել էր կտտանքների և ծիսական գլխատման. Արտակ Զեյնալյանը` ՄԻԵԴ վճիռների վերաբերյալ
INTERNATIONAL NEWSԻրավապաշտպան Արտակ Զեյնալյանը հաղորդագրություն է տարածել Մամիկոն Խոջոյանի և Կարեն Պետրոսյանի գործերով ՄԻԵԴ վճիռների վերաբերյալ: Դրանում ասված է.
«Այսօր՝ 04.11.2021թ ՄԻԵԴ-ի կողմից հրապարակվեց երկար սպասված երկու վճիռներ՝ Ադրբեջանական պաշտոնատար անձանց կողմից համապատասխանաբար՝ 28.01.2014թ և 07.08.2014թ ազատազրկված (ձերբակալված) Մամիկոն Խոջոյանի և Կարեն Պետրոսյանի գործերով։
Մ. Խոջոյանը (Տավուշի մարզի Վերին Կարմիրաղբյուր համայնքի բնակիչ) անհետացել էր Հայաստանի տարածքում դաշտում խաղող հավաքելիս, և հայտնվել Ադրբեջանի իրավազորության ներքո: 04.03.2014թ․ Մ. Խոջոյանը վերադարձվել էր հայկական կողմին և երկուս ու կես ամիս անց մահացել։ Ադրբեջանում ազատազրկման մեջ նա ենթարկվել է կտտանքների, այդ թվում՝ ստացել էր հրազենային վիրավորում, ինչպես նաև՝ նրան ներակել էին սոլյարայուղ:
Կ. Պետրոսյանը (Տավուշի մարզի Չինարի համայնքի բնակիչ) ցախ հավաքելիս մոլորվել էր և հայտնվել ադրբեջանական Աղբուլաղ գյուղում, ապա ձերբակալվել էր Ադրբեջանի իշխանությունների կողմից: Մեկ օր անց իշխանությունները հայտարարեցին, որ Կարենը մահացել է սրտի կաթվածից: Նրա աճյունը հայկական կողմին, հարազատներին վերադարձվել էր երկու ամիս անց՝ արհեստականորեն նեխած վիճակում: Ադրբեջանում Կարենը ենթարկվել էր կտտանքների և ծիսական գլխատման:
ՄԻԵԴ-ը երկու գործերով ճանաչել է Մարդու Իրավունքների Եվրոպական Կոնվենցիայով երաշխավորված հիմնական իրավունքների խախտումը, այն է՝ 2-րդ հոդվածի (կյանքի իրավունք), 3-րդ հոդվածի (խոշտանգումների արգելում), 5-րդ հոդվածի (ազատության և անձնական անձեռնամխելիության իրավունք) այդ հոդվածներով երաշխավորված իրավունքների խախտումները։
13-րդ հոդվածի (իրավական պաշտպանության արդյունավետ միջոցի իրավունք) և 14-րդ հոդվածի (խտրականության արգելում) հոդվածներով առանձին քննություն Դատարանը չի իրականացրել, քանի որ այդ իրավունքների խախտումը իրականացված ազգային ատելության հողի վրա արդեն իսկ ճանաչել է 2-րդ և 3-րդ հոդվածներով սահմանված իրավունքների խախտումների ճանաչմամբ։
Մասնավորապես Դատարանը նշում է, որ Կոնվենցիայի 13-րդ և 14-րդ հոդվածներով ներկայացված գանգատները հիմնված են նույն փաստերի վրա, ինչ 2-րդ, 3-րդ և 5-րդ հոդվածներով: Ավելին, Դատարանը հաշվի է առնում այն պատճառաբանությունը, որը հանգեցրել է ճանաչելու 2-րդ հոդվածի խախտումներ. դրա բովանդակային, ինչպես նաև ընթացակարգային ասպեկտները, և 3, մասնավորապես, որ պատասխանող Կառավարությունը չի կատարել իր ապացուցման բեռը դիմումատուների այն պնդումների առնչությամբ, որ Մամիկոն Խոջոյանը և Կարեն Պետրոսյանը ենթարկվել են դաժան վերաբերմունքի, որը հավասար է խոշտանգումների և նրանց կյանքը գտնվել է անմիջական վտանգի տակ։ Ավելին պատասխանող պետությունը որևէ հետաքննություն չի իրականացրել նրանց գերության մեջ գտնվելու ժամանակ նրանց նկատմամբ վերաբերմունքի վերաբերյալ, թեև՝ իրավիճակը դա պահանջում էր։
Դատարանը Մամիկոն Խոջոյանի և Կարեն Պետրոսյանի ընտանիքի անդամների ոչ նյութական վնասի հատուցում է սահմանել 40,000-կան եվրո։
Գործերը ներպետական ատյաններում և ՄԻԵԴ-ում վարել են Քրիստինա Գևորկյանը, Լարիսա Ալավերդյանը, Վահե Գրիգորյանը և Արտակ Զեյնալյանը»։
