«Փաստ» օրաթերթը գրում է

«Փաստ» թերթի տեղեկություններով, օրերս Նիկոլ Փաշինյանի մոտ տեղի է ունեցել քննարկում, որի հիմնական թեման կապված է եղել «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի և դրա կիրառելիության հետ։ Մեր աղբյուրների փոխանցմամբ, քննարկմանը մասնակցել է մասնագետների բավական լայն շրջանակ, հիմնականում՝ տնտեսագետներ և իրավաբաններ։ Փաշինյանը բավական նյարդային կերպով դժգոհել է, որ օրենքը գրեթե չի կիրառվում, քանի որ փաստացի դրա արդյունքները ոչ մի կերպ նկատելի չեն։ Նա ասել է, որ «պրոցեսը չի արդարացնում մեր սպասումները, որոնք բոլորս ակնկալում էինք այն ընդունելիս»։

Փաշինյանին քաղաքավարի բացատրել են, որ տեղի է ունենում բնական գործընթաց, քանի որ այդ գործընթացը բավական ծավալուն է ու դժվար ընթացող իրավակարգավորում է ենթադրում, ուստի հնարավոր չէ մի քանի ամսում մարդկանց գույք բռնագրավել, ապացուցել դրա ապօրինի լինելը, այնուհետև այն դարձնել պետության սեփականություն։

Մասնագետների բնորոշմամբ, այդ ամենը տևական ժամանակ պահանջող գործընթաց է, այնպես որ, զարմանալու և անհանգստանալու ոչինչ չկա։ Հայաստանյան փորձառու տնտեսագետներից մեկը, որը նախկինում բարձր պաշտոններ է զբաղեցրել, «Փաստ» թերթի հետ զրույցում նշեց, որ վերջին երեք տարում ընդունված ոչ մի օրենսդրական ակտ, առավել ևս՝ այս մեկը, ուղղված չէ որևէ իրավահարաբերության կարգավորման կամ խնդրի լուծման, այլ ընդհակառակը՝ միայն վնասում է մինչ այդ գոյություն ունեցող առողջ մթնոլորտին։

«Խնդիրն այն է, որ իշխանությունները կարծում էին, թե անհատից գույք խլելը կամ ունեզրկելը միանգամից, մի ակնթարթում իրականացվող գործընթաց է, և շատ արագ կարողանալու են նախ՝ խլել սեփականատիրոջից գույքը, հետո վաճառքից գոյացած գումարը պետականացնել: Իրականում այդ ամենը բավականին բարդ իրավակարգավորվող գործընթաց է, որը ամիսների, եթե ոչ տարիների լուծում է պահանջում»,-նշել է տնտեսագետը։
