ՀՀ-ում իրավիճակը անհամատեղելի է դատական համակարգի անկախության հետ. GRECO
POLITICSGRECO-ն («Կոռուպցիայի դեմ պետությունների խումբ») հրապարակել է միջանկյալ զեկույց, որով գնահատվում է Հայաստանի իշխանությունների ձեռնարկած միջոցառումները` գնահատման չորրորդ փուլի վերաբերյալ զեկույցում ներառված առաջարկությունների իրականացման համար:
GRECO-ի գնահատման չորրորդ փուլը նվիրված է «խորհրդարանի անդամների, դատավորների եւ դատախազների կաշառակերության կանխարգելմանը»:
GRECO-ն գնահատման չորրորդ փուլի վերաբերյալ իր զեկույցում Հայաստանին 18 առաջարկություն է ուղարկել: Երկրորդ զեկույցում GRECO-ն եկել է եզրակացության, որ յոթ առաջարկություններ բավարար կերպով կատարվել են, եւ եւս տասնմեկ առաջարկություններ կատարվել են մասամբ:
GRECO-ն եզրակացրել է, որ Հայաստանը որոշ սահմանափակ քայլեր է ձեռնարկել` գնահատման չորրորդ փուլում սպասվող առաջարկությունների իրականացման համար: Գնահատման չորրորդ փուլի հաշվետվությունում ներառված տասնութ առաջարկություններից յոթը դեռեւս բավարար չափով կատարված չեն:
Ինչ վերաբերում է խորհրդարանի անդամներին, ապա առաջնահերթությունը մնում է օրենսդրական գործընթացի թափանցիկությունը՝ շեշտը դնելով օրենսդրական գործընթացում հասարակության ներգրավվածության եւ «անհետաձգելի ընթացակարգերի» կիրառման վրա: Պատգամավորների էթիկայի օրենսգրքի նախագիծը եւ Ազգային ժողովի կանոնակարգում փոփոխությունների նախագիծը, որոնք նախատեսված են անդամների կողմից էթիկայի նորմերի պահպանման վերահսկման մեխանիզմ ստեղծելու համար, մշակվել են, սակայն դեռեւս չեն ներկայացվել GRECO-ի քննարկմանը:
Պատգամավորների կողմնակի գործունեության վերահսկողությունն ավելի համակարգված է դարձել, սակայն շոշափելի արդյունքներ դեռեւս չեն գրանցվել:
Ինչ վերաբերում է դատական համակարգին, ապա դատավորների նկատմամբ կարգապահական վարույթներում արդարադատության նախարարի ազդեցությունը չի դադարեցվել, եւ ներկա իրավիճակը անհամատեղելի է դատական իշխանության անկախության հետ: Դատավորների նշանակման համար գոյություն ունեն համապատասխան բողոքարկման մեխանիզմներ, սակայն ոչ հեռացման մասին որոշումների համար: Թեեւ դատախազների հետ խորհրդակցելու ներքին մեխանիզմը առանձնացված է կարգապահական մարմիններից, սակայն գործնականում դրա աշխատանքի կամ Կոռուպցիայի կանխարգելման հանձնաժողովի կողմից դատախազներին առաջարկվող անհամատեղելիության եւ այլ սահմանափակումների վերաբերյալ ոչ մի ապացույց չկա: Էթիկայի նպատակային, պարտադիր եւ կանոնավոր ուսուցումը դեռեւս չի ներդրվել բոլոր գործող դատախազների համար:
Ի վերջո, խորհրդարանի անդամների, դատավորների եւ դատախազների մասով նշվում են նվերների վերաբերյալ դրույթները, սակայն չի հաստատվում՝ կա՞ թույլատրելի նվերների գրանցման ընթացակարգ: Բացի այդ, դեռեւս անհրաժեշտ է ձեռնարկել համապատասխան միջոցներ` ակտիվների, հայտարարագրերի, շահերի բախումների վերաբերյալ կանոնների արդյունավետ վերահսկողություն եւ կիրառում ապահովելու համար:
Ելնելով վերոգրյալից՝ GRECO-ն նշել է, որ առաջարկություններին համապատասխանության ներկայիս մակարդակը մնում է «գլոբալ առումով անբավարար»:
Հայաստանի պատվիրակությունը պետք է հնարավորինս շուտ զեկույց ներկայացնի չիրականացված առաջարկությունների իրականացման ուղղությամբ ձեռնարկված միջոցառումների մասին ոչ ուշ, քան մինչեւ 2022 թվականի սեպտեմբերի 30-ը:
