Լրագրողին չի կարելի զրկել «առաջին ձեռքից» կամ «տաք» տեղեկություններ ստանալու

Անթույլատրելի են այսօր Ազգային ժողովի անվտանգությունն ապահովող ծառայության աշխատակիցների կողմից ԱԺ նիստերի դահլիճի օթյակից լուսանկարահանում և տեսանկարահանում իրականացնող ԶԼՄ ներկայացուցիչների մասնագիտական աշխատանքները դադարեցնելը և օթյակից դուրս գալուն պարտադրելը:

Ավելին, մի շարք լրագրողներ ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմին տեղեկացրել են, որ անվտանգության ծառայողներն իրենց նշել են, որ լրագրողներին կթույլատրեն օթյակում մասնագիտական աշխատանք կատարել, բայց նիստերի դահլիճում միջադեպերի դեպքում պետք է լքեն օթյակը և իրավունք չունեն միջադեպեր (նաև բռնություն) լուսաբանել, այդ թվում` նկարահանել:

Մարդու իրավունքների պաշտպանի դիրքորոշմամբ` լրագրողին չի կարելի զրկել «առաջին ձեռքից» կամ «տաք» տեղեկություններ ստանալու, այդ թվում՝ տեղում պատգամավորներին հարցեր ուղղելու, հարցազրույց վարելու կամ մեկնաբանություն ստանալու իրավունքից:

Լրագրողը չպետք է զրկվի հենց անձամբ ու տեղում պատգամավորից կամ այդ տեղեկությունները ստանալու հնարավորությունից, այդ թվում՝ աշխատելով, օրինակ, միջանցքներում:

Այս կանոններն ուղղակիորեն բխում են միջազգային իրավաբանությունից (օրինակ՝ Մանդլին և այլոք ընդդեմ Հունգարիայի գործով (Mándli and others v. Hungary) Մարդու իրավունքների եվրոպական դատարանի 2020 թվականի հոկտեմբերի 12-ի վճիռը, գանգատ թիվ 63164/16, ԵԽ մարդու իրավունքների հանձնակատարի դիրքորոշումներ և այլն):

Ազգային ժողովի անվտանգության ապահովումն ունի հիմնարար կարևորություն, բայց լրագրողների աշխատանքի սահմանափակումները չպետք է «թաքցվեն» անվտանգության կանոնների հետևում:

Ուստի, անընդունելի են լրագրողների աշխատանքի սահմանափակումների հիմքում, օրինակ, ահաբեկչական ակտերի կամ այլ ծանր հանցանքների կանխման հիմնավորումներ դնելը:

Պետք է հաշվի առնել, որ խոսքը ԱԺ-ում հավատարմագրում ունեցող լրագրողների մասին է և հետո՝ նրանք ԱԺ մուտք գործելիս արդեն ենթարկվում են ստուգման ԱԺ անվտանգությունն ապահովող ծառայության կողմից, այդ թվում՝ համապատասխան սարքերով, և նրանց նկատմամբ լրացուցիչ սահմանափակումների կիրառումն այն հիմքով, որ արվում է անվտանգության համար, անընդունելի է:

Լրագրողների աշխատանքի առանձնահատկությունները պետք է բխեն բացառապես ԱԺ-ում աշխատանքների բնականոն կազմակերպման պահանջից, բայց դրանք չպետք է հանգեցնեն լրագրողների աշխատանքի խոչընդոտների:

ԱԺ շենքում լրագրողների աշխատանքների սահմանափակումների առնչությամբ Մարդու իրավունքների պաշտպանի մանրամասն դիրքորոշումներն արդեն իսկ հրապարակվել են:
