ՀՀ ԱԺ պատգամավոր Արմեն Գևորգյանին դատարան բերման ենթարկելու՝ դատավոր Աննա Դանիբեկյանի որոշումը, պարզ ասած, այն մասին է վկայում, թե որքան խոցելի կարող է լինել մեր դատական համակարգը։ Արմեն Գևորգյանը, որն անցնում է հայտնի «Սիլվայի գործով», այժմ պատգամավոր է ու անձեռնմխելի է Սահմանադրությամբ։ Օգոստոսի 10-ին նա մասնակցում էր ԱԺ նիստին՝ Սահմանադրությամբ սահմանված՝ ԱԺ ղեկավարության ընտրությանը, և չէր ներկայացել դատական նիստին։ Աննա Դանիբեկյանը բացակայությունը համարեց անհարգելի՝ ըստ էության համարելով, որ Սահմանադրությունը՝ մի կողմ, կարևորը՝ դատախազության տեսակետը պաշտպանվի։

Շեշտենք՝ Աննա Դանիբեկյանը որոշում կայացրեց հաջորդ անգամ բերման ենթարկել Արմեն Գևրոգյանին այն դեպքում, երբ նա անձեռնմխելի է, և անձեռնմխեիությունը որևէ կերպ չի հաղթահարվել։ Արմեն Գևորգյանը հանդիսանում է այն 107 պատգամավորներից մեկը, որը պետք է ներկայացնի գրեթե 3 մլն բնակչությանը, անկախ նրանից, թե ինչ կուսակցության են ընտրել։ Հենց դա է պատճառը, որ ԱԺ պատգամավորները ոչ թե 3 մլն են, այլ 107, քանի որ իրենցից յուրաքանչյուրն ունի ամբողջ հայ ժողովրդին ներկայացնելու մանդատ և այդ մանդատից բխող պարտականություն, լիազորություններ և անձեռնմխելիություն։ Ի դեպ, այդ բոլորը երաշխավորված է Սահմանադրությամբ։

Եվ պատահական չէ, որ իրավաբանական հանրությունը, նաև շատ փորձագետներ տրամաբանական հարց են բարձրացնում՝  եթե Աննա Դանիբեկյանը, լինելով դատավոր, նշվածը չի պատկերացնում, չի պատկերացնում ԱԺ պատգամավորի գործունեության կարևորութունը, դերը և տեղը, ինչպե՞ս կարող է առհասարակ արդարադատություն իրականացնել։ Արդյո՞ք դատավորը կարող է, իրավունք ունի նման պարզ ճշմարտությունը չպատկերացնել։

Ընդ որում, անձեռնմխելիության հետ նման կամայականորեն օգտվելը կարող է վատ պրակտիկա դառնալ։

Մենք տեսանք, որ խորհրդարանում մեկ ձայնն անգամ կարևոր էր, երբ ԱԺ փոխնախագահ էին ընտրում։ Հիմա պետք է ընտրեն հանձնաժողովների ընդդիմադիր նախագահների, որոնց իշխանությունը թեև պարտավոր է, բայց քվե տալ չի ցանկանում և էլի կարող է թատրոն սարքել։ Դա գործող իշխանություններից, շատ մեղմ ասած, հեռու չէ: Այս պարագայում, ստացվում է, որ Աննա Դանիբեկյանը, կամա թե ակամա, համագործակցում է իշխանության հետ և հանձնաժողովի նախագահի թեկնածուներից մեկին որոշում ու հրահանգում է բերման ենթարկել։

Հետայսու կարող են իշխանության պատվերի արդյունքում քրգործեր սարքել ընդդիմադիր տարբեր պատգամավորների վրա, բերման ենթարկել, կալանավորել, ու այդպես գլխատել ընդդիմադիր խմբակցությունները։ Մենք արդեն ունենք այդ նախադեպը, երբ անձեռմխելիությամբ օժտված երկու ընդդիմադիր պատգամավոր կալանքի տակ են և փաստացի չկարողացան ներկայացնել իրենց դիրքորոշումները ԱԺ նախագահ ընտրվելու համար և տեսականորեն գուցե չընտրվեցին հենց այդ պատճառով։

Կարելի է ենթադրել, որ այս ամենն արվում է իշխանության հետ գործարքի կամ որոշակի պայմանավորվածությունների արդյունքում, և ստացվում է, որ իշխանությունը դատավորներին օգտագործում է իր քաղաքական հարցերն ի մի բերելու համար։
