Գերիների շահերի շարունակական ներկայացումը ՄԻԵԴ-ում անհրաժեշտություն է․ Փաստաբանների պալատ
SOCIETYԻնչպես արդեն հայտարարվել էր, ՀՀ փաստաբանների պալատը իր պատրաստակամությունն էր հայտնել օժանդակելու Ադրբեջանում գերության մեջ գտնվող մեր հայրենակիցներին ՀՀ փաստաբանների կողմից իրավաբանական օգնություն ցույց տալու՝ նրանց Ադրբեջանի բանտերում տեսակցելու, նրանց նկատմամբ Եվրոպական կոնվենցիայի հնարավոր խախտումների փաստերը պարզելու, արձանագրելու և այդ փաստերը Եվրոպական դատարան ու միջազգային այլ ատյաններ ներկայացնելու գործընթացին:
Այդ առաքելությունն իրականացնելու ուղիները որոշակիացնելու, հնարավոր ռիսկերը գնահատելու և կանխարգելելու, գերության մեջ գտնվող մեր հայրենակիցներին օգնելուն ուղղված գործողություններին համահունչ գործելու նպատակով ՀՀ փաստաբանների պալատի նախագահ Արա Զոհրաբյանը, նախագահի տեղակալներ՝ Մանե Կարապետյանը, Հարութ Ակլունցը, ինչպես նաև փաստաբան Հայկ Ալումյանը հանդիպումներ են ունեցել Մարդու իրավունքների եվրոպական դատարանում Հայաստանի Հանրապետության ներկայացուցչի, նրա տեղակալի և այլ մասնագետների հետ:
Հերթական հանդիպումը տեղի է ունեցել ՀՀ փաստաբանների պալատում մասնակցության պատրաստակամություն հայտնած փաստաբանների, ինչպես նաև գերության մեջ գտնվող մեր հայրենակիցների շահերը Մարդու իրավունքների եվրոպական դատարանում և ներպետական ատյաններում ներկայացնող իրավաբաններից՝ Արտակ Զեյնալյանի միջև:
Քննարկումների ընթացքում ներկայացվել են բոլոր հնարավոր ռիսկերը փաստաբանների Ադրբեջան ուղևորվելու և այնտեղ գերության մեջ գտնվող մեր հայրենակիցներին իրավաբանական օգնություն ցույց տալու հետ կապված:
Քննարկումների արդյունքում մասնակիցները եկել են եզրակացության, որ գերության մեջ գտնվող մեր հայրենակիցների շահերի շարունակական ներկայացումը Մարդու իրավունքների եվրոպական դատարանում անհրաժեշտություն է։ Այդ նպատակով գերության մեջ գտնվող անձանց շահերը ներկայացնող թիմը միջոցներ է ձեռնարկում վստահորդներին Ադրբեջանի ազատազրկման վայրերում այցելելու նպատակով և պատրաստակամություն է հայտնել նպատակին հասնելու դեպքում՝ դիմել կամավորագրված փաստաբաների օժանդակությանը:
Միաժամանակ, ՀՀ փաստաբանների պալատը կրկին ընդգծում է, որ խոսքը գերության մեջ գտնվող մեր հայրենակիցների պաշտպանությունը Ադրբեջանի ներպետական օրենսդրությանբ նախատեսված դատարաններում իրականացնելու մասին չէ և միանում է ՀՀ իշխանությունների ու քաղաքացիական հասարակության ներկայացուցիչների այն գնահատականին, որ այդ դատավարությունները լեգիտիմ համարվել չեն կարող:
