«Պատիվ ունեմ» դաշինքն ահազանգում է

«Պատիվ ունեմ» կուսակցությունների դաշինքի հայտարարությունը ՀՀ-ում հավատարմագրված օտարերկրյա լրատվամիջոցների կոնտակտային տվյալները չտրամադրելու վերաբերյալ․

«Պատիվ ունեմ» կուսակցությունների դաշինքը դիմել է Արտաքին գործերի նախարարություն՝ 2021 թ. Ազգային ժողովի արտահերթ ընտրություններին հավատարմագրված օտարերկրյա լրատվամիջոցների կոնկատային տվյալները ստանալու խնդրանքով, որին ի պատասխան ստացել է մերժում։

Նախարարությունը մերժումը պայմանավորել է երկու հանգամանքով․

1․Հարցումը պետք է ներկայացվի գրավոր,

2․Կոնտակտային տվյալները հանդիսանում են անձնական տվյալ և դրանց տրամադրումը երրորդ անձանց անթույլատրելի է։

Հայտարարում ենք, որ Արտաքին գործերի նախարարության գործողությունները ոչ այլ ինչ են, քան նախընտրական քարոզչության շրջանում լրատվամիջոցների հետ Դաշինքի հաղորդակցությունը արհեստականորեն խոչընդոտելուն միտված դիտավորություն։

Հավատարմագրման նպատակը լրատվամիջոցների կողմից ընտրությունների և քվեարկության վերաբերյալ լուսաբանում իրականացնելու հնարավորություն ստանալն է։ Ակնհայտ է, որ հավատարմագրման գործընթաց անցած լրատվամիջոցներն առավել քան շահագրգռված են իրենց գործառույթների ամբողջական իրականացմամբ և վերջիններիս հետ կապ հաստատելու միջոցները չեն կարող դիտվել որպես օրենքով պաշտպանվող և հրապարակման ոչ ենթակա անձնական տվյալ։

Ճիշտ հակառակը, «զանգվածային լրատվական գործունեություն» անվանումը պարզորոշ վկայում է, որ այս գործունեությունն իրականացնողը նպատակ ունի հանրային հասանելիություն ունենալ, ինչից և բխում է, որ նրանք իրենց հետ կապ հաստատելուն ուղղված տվյալները հասանելի՝ հանրամատչելի են դարձնում սեփական կամքով։

Գրավոր հարցում ներկայացնելու ձևական պահանջի չարաշահմամբ, Արտաքին գործերի նախարարությունը հետապնդում է միայն մեկ նպատակ՝ օգտվելու գրավոր հարցմանը պատասխանելու օրենքով նախատեսված 5-օրյա ժամկետից։ Հաշվի առնելով նախընտրական շրջանի սահմանափակ տևողությունը, այս ճանապարհով նախարարությունը փորձում է հնարավորինս սահմանափակել և կանխարգելել քաղաքական ուժերի շփումը օտարերկրյա լրատվամիջոցների հետ։

Ժողովրդավարության սահմանադրական սկզբունքի հիմքում ընկած և դրա շարժիչ ուժը հանդիսացող ազատ հաղորդակցության սկզբունքի նման խոչընդոտումը անթույլատրելի է։

Արտաքին գործերի նախարարության գործողությունները չեն հետապնդում որևէ լեգիտիմ նպատակ և կոպտորեն խախտում են Սահմանադրությամբ նախատեսված տեղեկություններ փնտրելու և ստանալու ազատության, ինչպես նաև տեղեկատվության ազատության հիմնարար իրավունքները:

Նման գործողությունները մենք դիտարկում ենք որպես պետական ապարատի ապօրինի գործադրմամբ՝ «Պատիվ ունեմ» կուսակցությունների դաշինքի հրապարակային գործունեությունը խոչընդոտելու հերթական անթաքույց փորձ, ինչպես նաև միջազգային հանրությանը Հայաստանի ներքաղաքական իրավիճակի մասին օբյեկտիվ տեղեկատվության ներկայացման կանխման աղաղակող դրսևորում:
