«Ժողովուրդ» օրաթերթը գրում է. «Սահմանադրական դատարանը եւս մեկ ապտակ հասցրեց գլխավոր դատախազին: Երեկ սահմանադրական դատարանը մերժել է վարույթ ընդունել ՀՀ գլխավոր դատախազի դիմումը, որով նա, ըստ էության, խնդրում էր, որ Սահմանադրական դատարանը թույլ տա իրեն, որ ինքը փոխի երկրորդ Նախագահ Ռ.Քոչարյանի մեղադրանքը:

Անգամ անցած շաբաթ Արթուր Դավթյանը Ազգային ժողովում հայտարարեց, որ խնդիրը փակված չէ, եւ ինքը դիմել է ՍԴ, իսկ այդ որոշումից հետո գործի ընթացքը կշարունակվի։ Եվ, ահա, երեկ Սահմանադրական դատարանը մերժում է Արթուր Դավթյանին՝ եւս մեկ անգամ ցույց տալով, որ իր իրավական վերլուծություններն ու մոտեցումները չեն համապատասխանում ՀՀ Սահմանադրության պահանջներին:

Այսինքն՝ Արթուր Դավթյանը «Մարտի 1»-ի գործը ի սկզբանե տարել է հակասահմանադրական ճանաապարհով՝ այս երեք տարին անընդհատ կրկնելով, որ ամեն ինչ օրինական է: Այսինքն՝ կա՛մ դիտավորյալ է տարել այդ ուղղությամբ, կա՛մ պրոֆեսիոնալիզմի պակաս է. երկուսն էլ մահացու է:

Հիմա առարկայական. Արթուր Դավթյանը ՀՀ գլխավոր դաախազ է արդեն հինգ տարի, եւ եթե ուշադիր լինենք, արդեն հինգ տարի է՝ նա նույն բառակապակցությամբ ԱԺ ամբիոնից խոսում է «Մարտի 1»-ի 10 զոհերի բացահայտման ուղղությամբ կատարված աշխատանքների մասին, իսկ արդյունքը, արդեն հինգ տարի է, չկա: Ի դեպ, անցած շաբաթ ԱԺ ամբիոնից նա հայտարարեց՝ ով կարող էր երաշխավորել, որ եթե այլ հոդվածով մեղադրանք առաջադրեին, այդ հոդվածը սահմանադրական դատարանը չէր ճանաչի հակասահմանադրական:

Սա, հավատացեք, տարօրինակ հայտարարություն է գլխավոր դատախազի կողմից: Արդեն երեք կամ երկու տարի է՝ տարբեր տրամաչափի իրավաբաններ, եվրոպական դատարանը, Վենետիկի հանձնաժողովը պնդում եւ հիմնավորում են, որ այդ հոդվածը, որով մեղադրում են անձանց, հակասահմանադրական է, իսկ գլխավոր դատախազը իր հայտարարություններում հայտնում էր նույն արտահայտությունները՝ մեղադրանքները համապատասխանում են մեր օրենսդրության պահանջներին եւ այլն: Գլխավոր դատախազը եւս իրավունք ուներ դիմել Սահմանադրական դատարան՝ ստուգելու այդ հոդվածի՝ սահմանադրության համապատասխանության հարցը:

Ի՞նչ ունենք հիմա: Ադյունքում, 2018թ սկսած, արդեն 3 տարի է՝ Արթուր Դավթյանը մեզ բոլորիս հավաստիացնում էր, որ այս գործով ամեն ինչ հիմնավոր է եւ օրինական, իսկ Սահմանադրական դատարանը համարեց, որ հոդվածը հակասահմանադրական է, հետեւաբար մեղադրանքը ապօրինի է, իսկ դատարանը դադարեցրեց այդ մեղադրանքները: Արդեն երկրորդ անգամ Սահմանադրական դատարանը բացատրեց Արթուր Դավթյանին, որ ինքը տեղյակ չէ ՀՀ Սահմանադրությունից:

Ունենք սա, այսինքն՝ Արթուր Դավթյանը, արդեն հինգ տարի է՝ ՀՀ գլխավոր դատախազ է, իսկ 10 անձանց սպանությունը բացահայտված չէ, եւ որեւէ մեկը պատժված չէ: Սա փաստ է, իսկ որ ներկայացվում է, թե ինչ տաժանակիր աշխատանք է կատարվել այդ գործով, ապա կա մի պարզ բանաձեւ՝ կատարված աշխատանքի արդյունավետությունը որոշվում է արդյունքներով: Իսկ ինչպես տեսնում ենք, արդյունք չկա»:
