Ինչ հանցագործություններ են կատարվել պատերազմի ընթացքում և ինչ է արել զինվորական դատախազությունը․ «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է․ ««ԱԺ կանոնակարգ» օրենքի 128-րդ հոդվածի համաձայն՝ ՀՀ գլխավոր դատախազը յուրաքանչյուր տարի՝ մինչեւ ապրիլի 1-ը, Ազգային ժողով է ներկայացնում հաղորդում՝ Հայաստանի Հանրապետության դատախազության նախորդ տարվա գործունեության մասին: Եվ այս տարի ՀՀ գլխավոր դատախազ Արթուր Դավթյանն այն ներկայացրել է մարտի 30-ին՝ պահպանելով ժամկետները: Եվ չնայած «ԱԺ կանոնակարգ» օրենքում հաղորդում ներկայացնելու ժամկետները սահմանված են, սակայն այն ներկայացնելունը սահմանված չէ: «Ժողովուրդ» օրաթերթը տեղեկացավ, որ այս հաղորդումը խորհրդարանում քննարկելու ժամկետները դեռ հայտնի չեն, եւ չի բացառվում, որ առաջիկա նստաշրջանում այն դեռ չընդգրկվի օրակարգում, սակայն, ամենայն հավանականությամբ, մինչեւ արտահերթ ընտրությունների օրն այն կհասցնեն քննարկել: Օրինակ՝ 2019 թվականի տարեկան հաղորդագրությունը նախորդ տարի քննարկվել էր հունիսի 1-ին: Դատախազության 2020 թվականի հաշվետվությունը տարբերվում է հատկապես արցախյան պատերազմի մասին հիշատակումներով, թե ինչ է կատարվել զինվորական դատախազության ոլորտում:

2020թ. ընթացքում ՀՀ ԶՈւ-ի եւ այլ զորքերի զորամասերում արձանագրվել է 5601 դեպք՝ նախորդ տարվա 3495-ի դիմաց. աճ է արձանագրվել 2106 դեպքով կամ 60.2%-ով: «Ժողովուրդ» օրաթերթը հաղորդումից տեղեկացավ, որ հանցագործությունների դեպքերի կտրուկ աճը պայմանավորված է Ադրբեջանի կողմից սանձազերծված ագրեսիվ պատերազմով։ Առանձնապես ծանր հանցագործություններից 538-ը կամ 84,1%-ը պայմանավորված են եղել ռազմական դրությամբ։ Այսպիսով, 640 առանձնապես ծանր հանցագործություններից 9-ը եղել է հակառակորդի կողմից կատարված սպանություն, 2-ը` համածառայակցի կողմից կատարված սպանություն:

Հետաքրքիր է, որ ռազմական դրության ժամանակ եղել է զինծառայողի կողմից քաղաքացիական անձի սպանության եւ պահեստազորայինի կողմից պահեստազորայինի սպանության, պահեստազորայինի կողմից սպայի սպանության մեկական դեպքեր: Բացի այս, առկա է համածառայակցի կողմից կատարված սպանության փորձի 2 դեպք, պայմանագրային զինծառայողի կողմից քաղաքացիական անձի սպանության 1 փորձ, ռազմական դրության ժամանակ պետի նկատմամբ բռնություն գործադրելու 5 դեպք: Այլ ուշագրավ դեպքեր եւս կան, մասնավորապես՝ ռազմական դրության ժամանակ պետի կողմից իշխանությունը չարաշահելու, իշխանազանցության, իշխանության անգործության 18 դեպք, 374 դեպք՝ ռազմական դրության ժամանակ զորամասը կամ ծառայության վայրն ինքնակամ թողնելու, 3-ը՝ ռազմական դրության ժամանակ ստորադասի նկատմամբ բռնի գործողություններ կատարելու, 2-ը՝ ռազմական դրության ժամանակ հրամանը չկատարելու, 103-ը՝ ռազմական դրության ժամանակ դասալքության, 2-ը՝ ռազմական դրության ժամանակ անդամախեղման, 1-ը՝ մարտ վարելու միջոցները հակառակորդին թողնելու, 10-ը՝ ագրեսիվ պատերազմի: Գաղտնիք չէ, որ պատերազմից հետո քրեական գործեր են քննվում, եւ պետք է հուսալ, որ բոլոր հարցերի պատասխանները կտրվեն»:
