Դատախազության կողմից Արա Սաղաթելյանի կալանքը վերացնելու որոշման բողոքարկման պատճառը Սաղաթելյանի՝ իշխանությանն ուղղված քննադատությունն է․ քաղաքական պատվեր է․ փաստաբան

ԱԺ աշխատակազմի նախկին ղեկավար Արա Սաղաթելյանի կալանքը վերացնելու մասին Վերաքննիչ քրեական դատարանի որոշման բողոքարկումը ՀՀ գլխավոր դատախազության կողմից ունի մեկ պատճառ՝ Արա Սաղաթելյանի՝ գործող իշխանությանն ուղղված քննադատությունը։ Այս մասին Tert.am-ի հետ զրույցում ասաց Սաղաթելյանի պաշտպան Միհրան Պողոսյանը՝ մեկնաբանելով Դատախազության բողոքարկումը։

Միհրան Պողոսյանն ընդգծեց՝ Վերաքննիչ քրեական դատարանի որոշումը գերպատճառաբանված է եղել, և եթե բողոքում են նրանից, որ դատական ակտը գերպատճառաբանված է, նշանակում է՝ քաղաքական պատվեր կա։

«Ընդհանուր տպավորությունն այնպիսին էր, որ Դատախազության դիրքորոշումը հետևյալն էր՝ թող անձը մնա կալանքի տակ, մենք մեղադրանքի խոցելիությունը հետագայում կքննենք, կհասկանաք՝ վերացնելու ենթակա՞ է, թե՞ ոչ, ինչը բացարձակապես անթույլատրելի է։ Եթե անձին ազատությունից զրկում են, պետք է առկա լինի կալանավորման պայման, որն այս պահին չկա, և Վերաքննիչ քրեական դատարանը շատ հստակ ընդգծել էր, որ որևէ հոդվածով կալանավորման պայման գոյություն չունի»,-ասաց նա՝ նշելով, թե Դատախազությունը կարծում է, որ նման պայման գոյություն ունի, ու, ըստ Պողոսյանի, երկրորդ զավեշտին ենք ականատես լինում․

«Նույն քրեական գործի շրջանակներում, գրեթե նույն փաստական հանգամանքներով այլ անձանց վերաբերյալ այդ հիմնավոր կասկածի բացակայությունը դատարանի կողմից արձանագրելը հիմք էր տվել, որ Գլխավոր դատախազությունը այդ գործով վերաքննիչ բողոք չներկայացնի։ Այստեղ գալիս է մեր գնահատականն առ այն, որ այս վճռաբեկ բողոքի միակ տրամաբանությունն այն է, որ Արա Սաղաթելյանն ազատ արձակվելուց հետո միանգամայն իրավացիորեն և տեղին քննադատել է գործող իշխանություններին ու նրանց սատարող անձանց՝ մատնացույց անելով կոնկրետ սխալները, դավաճանության փաստերը, ապօրինությունները»,-ասաց փաստաբանը։

Նա հույս հայտնեց, որ մի օր ողջամտությունը կգերակշռի ու կհաղթի Գլխավոր դատախազությունում, և վերջինս կհասկանա պետության մեջ իր գործունեության իրական դերն ու նշանակությունը, ու այս գործին վերջ կդրվի։

«Բայց պետք է հաշվի առնել այն հանգամանքը, որ քաղաքական պատվերը կատարվում է այնքան ժամանակ, քանի դեռ կան կատարողներ։ Գլխավոր դատախազությունը պետք է գիտակցի՝ եթե չի ցանկանում հանդես գալ որպես պատվեր կատարող, ապա, եթե մի քանի գործով հրաժարվի պատվեր կատարել, այնուհետև պատվեր տվողը ևս ձեռնպահ կմնա դրանից, որովհետև կիմանա, որ կատարողներ չեն լինելու։ Այժմ չունենք այդ իրավիճակը, բայց ես վստահ եմ, որ այն վրա է հասնելու, և այդ պարագայում գործ ենք ունենալու իրական արդարադատության հետ»,-ասաց Միհրան Պողոսյանը։

Հիշեցնենք՝ փետրվարի 21-ին Երևանի ընդհանուր իրավասության դատարանը բավարարել էր ԱԺ աշխատակազմի նախկին ղեկավար Արա Սաղաթելյանին կալանավորելու վերաբերյալ ԱԱԾ միջնորդությունը։

Մարտի 5-ին Վերաքննիչ քրեական դատարանը բեկանեց Սաղաթելյանի կալանավորման մասին առաջին ատյանի դատարանի որոշումը՝ նրան ազատ արձակելով։
