«Փաստ» օրաթերթը գրում է

ՀՀ քրեական օրենսգրքի 300.1 հոդվածի հետ կապված ՍԴ հայտնի որոշման առնչությամբ գրեթե բոլորն էլ վստահ էին, որ Նիկոլ Փաշինյանը չի թաքցնի իր զայրույթն ու դժգոհությունը և անպայման կարտահայտվի: Եվ ահա, Արմավիրի մարզում նա ասել է, թե «որոշումը մի հատ պիտի կարդանք, տեսնենք՝ մեջն ինչ է գրված, որ հետագայի վերաբերյալ կայացնենք որոշումներ»: Շատերի համոզմամբ, այս հայտարարությամբ Փաշինյանը խոստովանում է, որ Մարտի 1-ի գործը բացառապես քաղաքական է և ուղղորդվում է գործող իշխանությունների կողմից, քանզի, ի վերջո, ի՞նչ գործ ունի երկրի վարչապետը որևէ քրեական գործի առնչությամբ որոշումներ կայացնելու հետ:

«ՀՀ վարչապետի աթոռը զբաղեցնող անձը երբևիցե չի թաքցրել և չի թաքցնում, որ իշխանության գալուց հետո ինքն ուղղակիորեն գործեր է սարքում, գործեր է կարում, անում է այն, ինչ իրեն ձեռնտու է՝ արհամարհելով և՛ օրենքները, և՛ Սահմանադրությունը: Իշխանության գալուց հետո ասում էր՝ «մարտի 1-ի գործը մեզ համար բացահայտված է»: Բայց անգամ այն դեպքում, երբ բացահայտ խայտառակվել է, առանց ամաչելու նույն տրամաբանության մեջ կրկին հայտարարություններ է անում, ինչը զարմանալի չէ: Նա բացահայտ ցույց է տալիս, որ հետքայլ չի անելու, որ նոր գործեր են սարքելու, կարելու, որպեսզի նույն Ռոբերտ Քոչարյանին և Մարտի 1-ի գործով անցնող նախկին պաշտոնյաներին, իրենց կարծիքով, «ահ ու սարսափի» մեջ պահեն»,«Փաստի» հետ զրույցում ասաց քաղաքագետ Գագիկ Համբարյանը: «Իրավական ուղի» ՀԿ համահիմնադիր Ռուբեն Մելիքյանի կարծիքով էլ, ՍԴ-ի շուրջ ամբողջ գործընթացն այս գործով էր պայմանավորված. «Եթե ուզում են կարդալ, թող կարդան:

Մեծ հաշվով, այդ ընթերցանությունն ընդամենը կարող է բարձրացնել որոշ անձանց իրավագիտակցության մակարդակը, թեպետ կարծում եմ, որ հատկապես «Իմ քայլի» ներկայացուցիչների համար դա ինչ-որ առումով արդեն ուշ է: Մյուս կողմից՝ կարծում եմ, որ շատ ավելի արտահայտիչ է սորոսական ուղղվածություն ունեցող գործիչների պնդումները՝ կապված ՍԴ դատավորների ընտրության ընթացակարգերի հարցերի հետ: Եվ հենց այդ պնդումներից կարելի է ուղիղ հետևություն անել, որ ՍԴ երեք դատավորի հեռացնելու, ՍԴ-ն կազմալուծելու ամբողջ գործընթացը պայմանավորված է եղել հենց այդ գործով և հենց այդ գործով ցանկալի որոշում կայացնելու նպատակով»,-ասաց Մելիքյանը:
