Նոր զարգացումներ Օնիկ Գասպարյանի գործով. դատավորը մերժել է Նիկոլ Փաշինյանի ներկայացուցչի միջնորդությունը
SOCIETYՀՀ վարչական դատարանի դատավոր Մհեր Պետրոսյանին ինքնաբացարկ հայտնելու վերաբերյալ Հայաստանի Հանրապետության վարչապետ Նիկոլ Փաշինյանի ներկայացուցչի միջնորդությունը մերժվել է։
ՀՀ ԶՈՒ գլխավոր շտաբի նախկին պետ Օնիկ Գասպարյանն ընդդեմ Նիկոլ Փաշինյանի և Արմեն Սարգսյանի գործով Նիկոլ Փաշինյանի ներկայացուցիչը դատավորին ինքնաբացարկի միջնորդություն էր ներկայացրել ՝ նշելով, թե պատասխանողի մոտ գործի՝ անկողմնակալ և օբյեկտիվ լուծման առնչությամբ համոզմունք առկա չէ։
Դատարանը որոշում է կայացրել այդ գործով ապրիլի 2-ին՝ ժամը 11։30-ին, նախնական դատական նիստ նշանակել։
Հիշեցնենք՝ ՀՀ վարչական դատարանը՝ դատավոր Մհեր Պետրոսյանի նախագահությամբ, բավարարել է ՀՀ ԶՈՒ ԳՇ պետ Օնիկ Գասպարյանի գործով հայցի ապահովման միջոց կիրառելու մասին փաստաբանի միջնորդությունը, որով պահանջվել էր կասեցնել Օնիկ Գասպարյանի պաշտոնանկությունը մինչև գործով վերջնական դատական ակտի կայացումը։
Մարտի 25-ին Բարձրագույն դատական խորհրդում ստացվել է Վարչական դատարանի դատավոր Մհեր Պետրոսյանից դիմում, որի կապակցությամբ Բարձրագույն դատական խորհրդի կողմից անմիջապես կազմակերպվել է քննարկում:
Կայացած քննարկումից հետո Բարձրագույն դատական խորհուրդը, ղեկավարվելով «Հայաստանի Հանրապետության դատական օրենսգիրք» սահմանադրական օրենքի 89-րդ հոդվածի 1-ին մասի 18-րդ կետով, ՀՀ գլխավոր դատախազություն է ուղարկել Վարչական դատարանի դատավոր Մհեր Պետրոսյանի՝ Բարձրագույն դատական խորհրդին ուղղված դիմումի պատճենը՝ ՀՀ դատախազության լիազորությունների շրջանակում դիմումում բարձրացված հարցերի լուծման ուղղությամբ անհրաժեշտ միջոցներ ձեռնարկելու համար:
ՀՀ գլխավոր դատախազությունը ստացել է Վարչական դատարանի դատավոր Մհեր Պետրոսյանի՝ Բարձրագույն դատական խորհրդին ուղղված դիմումը. դիմումն ուղարկել են Քրեական ոստիկանություն։
Ավելի վաղ հաղորդվել էր, որ ԱԱԾ աշխատակիցներն այցելել են Մհեր Պետրոսյանին և փորձել մուտք գործել դատավորի աշխատասենյակ։
