Էկոնոմիկայի նախարարությունն առաջարկում է լրացում կատարել 2018 թ.-ի նոյեմբերի 15-ի N 1287-Ն որոշման մեջ: Նշվում է, որ այս նախագծի ընդունման անհրաժեշտությունն ուղղված է գործող օրենսդրության, մասնավորապես՝ Աշխատանքային օրենսգրքի և գործող կառավարության որոշման միջև անհամապատասխանության վերացմանը և քաղծառայողների ամենամյա արձակուրդների հաջորդ աշխատանքային տարի տեղափոխման թույլատրելիությանը։ Քաղաքացիական ծառայության մասին օրենքի 30-րդ հոդվածի 5-րդ մասով սահմանված է, որ քաղծառայողին արձակուրդ տրամադրելու կարգը և պայմանները սահմանում է Կառավարությունը։

Բացի դա, Աշխատանքային օրենսգրքի 167-րդ հոդվածի 1-ին մասում նշվում է, որ ամենամյա արձակուրդի տեղափոխումը թույլատրվում է միայն աշխատողի միջնորդությամբ կամ համաձայնությամբ։ Սակայն կառավարության 2018 թ.-ի նոյեմբերի 15-ի որոշման հավելվածի 18-րդ կետով սահմանված է, որ քաղծառայողի միջնորդությամբ ամենամյա արձակուրդն այլ ժամանակ տեղափոխելու դեպքում այն տրամադրվում է տվյալ աշխատանքային տարում, բացառությամբ որոշման հավելվածի 19-րդ կետում նշված մի քանի բացառությունների: Այդ կետերը սահմանված են նաև Աշխատանքային օրենսգրքի 167-րդ հոդվածի 1-ին մասում։ Աշխատանքային օրենսգրքով սահմանված նորմերը չեն խոչընդոտում աշխատողի ամենամյա արձակուրդի տեղափոխմանը, եթե դրա տրամադրման համար 18 ամսվա ժամանակահատվածը չի անցել, ինչը հնարավորություն է տալիս ամենամյա արձակուրդը տեղափոխել հաջորդ աշխատանքային տարի։

Նշվում է, որ այստեղ ակնհայտ է գործող որոշման անհամապատասխանությունը ավելի բարձր իրավաբանական ուժ ունեցող օրենքին՝ Աշխատանքային օրենսգրքին, որի 167-րդ հոդվածի 3-րդ մասով սահմանված է, որ ամենամյա արձակուրդը, որպես կանոն, տրամադրվում է նույն աշխատանքային տարում, բայց ոչ ուշ, քան 18 ամսվա ընթացքում՝ սկսած այն աշխատանքային տարվա վերջից, որի համար աշխատողին չի հատկացվել կամ մասնակի է հատկացվել ամենամյա արձակուրդը։

Աշխատողի միջնորդությամբ կամ համաձայնությամբ ամենամյա արձակուրդի չօգտագործված մասը կարող է տեղափոխվել և միացվել հաջորդ տարվա ամենամյա արձակուրդին։ Գործող օրենքների և կառավարության ընդունած որոշման անհամապատասխանությունը շտկելուն է միտված էկոնոմիկայի նախարարության կողմից հանրային քննարկման ներկայացված նախագիծը: Մասնավորապես՝ դրա ընդունման դեպքում քաղաքացիական ծառայողները հնարավորություն կստանան իրենց ամենամյա արձակուրդը տեղափոխել այլ ժամանակ, ավելի կոնկրետ՝ հաջորդ աշխատանքային տարի:
