Զինված ուժերի գլխավոր շտաբի պետը դեռ շարունակում է պաշտոնավարել: Այս մասին Facebook-ի իր էջում գրել է Փաստաբանների պլատի նախագահ Արա Զոհրաբյանը:

Նա, մասնավորապես, նշել է. «Վարչապետը հայտարարել է, որ  2021թ. մարտի 10-ից ՀՀ ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանն իրավունքի ուժով համարվում է ազատված զբաղեցրած պաշտոնից (իրականում իրավունքի ուժով համարվում է նախագահի հրամանագիրն ընդունված):

Այս պարագայում առկա է երկու խնդիր:

1. Զինվորական ծառայության առանձնահատկությամբ պայմանավորված, նախագահի ուժի մեջ մտած հրամանագիրը (եթե այն համարենք վավեր իրավական ակտ) բավարար չէ բարձրաստիճան սպային զբաղեցրած պաշտոնից ազատելու համար:  Պետք է հրամանագրին հաջորդի հանձնման-ընդունման գործընթաց, որը պետք է ամփոփվի զինվորական կառավարման մարմնի անձնակազմի և բավարարման (ապահովման) ցուցակից հանելու մասին առանձին իրավական ակտով: Միայն այդ պահից կհամարվի զինծառայողի ծառայությունն ավարտված:

Հիշեցնեմ ԳՇ պետի առաջին տեղակալ Տիրան Խաչատրյանի հանգամանքը: Վերջինս նախագահի հրամանագրով ազատված է պաշտոնից, սակայն առ այսօր իրականացնում է ԳՇ պետի առաջին տեղակալի լիազորությունները, քանի որ հանձնման-ընդունման գործընթացն ավարտված չէ և համապատասխան ցուցակից հանելու մասին իրավական ակտն ընդունված չէ:

2. ՀՀ Սահմանադրության 155-րդ հոդվածի 3-րդ մասի մեկնաբանությամբ, ԳՇ պետ Օնիկ Գասպարյանը կարող է պնդել, որ նախագահի հրամանագիրն առ ոչինչ ակտ է: Առ ոչինչ վարչական ակտն ընդունման պահից իրավաբանական ուժ չունի և ենթակա չէ կատարման կամ կիրառման: Առ ոչինչ վարչական ակտի կատարումը կամ կիրառումն առաջացնում է օրենքով սահմանված պատասխանատվություն: (Տես՝ «Վարչարարության հիմունքների վարչական վարույթի մասին» օրենքի 62-րդ հոդվածի 1-ին մասի «դ» կետը, 2-րդ և 3-րդ մասերը):

Այս պայմաններում, երբ Հանրապետության նախագահն էլ է արձանագրել Սահմանադրության 155-րդ հոդվածի 3-րդ մասի հետ հրամանագրի առերևույթ հակասությունը և խուսափել է այդ վեճը իրավասու մարմնին՝ Սահմանադրական դատարանին փոխանցելու իր պարտականության կատարումից, ԳՇ պետը  և իր անձնակազմը կարող են նաև վստահելով նախագահի հրապարակային մեկնաբանությանը, պնդել նախագահի հրամանագրի առոչինչ լինելը:

Բոլոր դեպքերում, դեռևս այս պահին, ԳՇ պետը շարունակում է պաշտոնավարել:

Նախագահի կողմից «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի սահմանադրականության հարցով ՍԴ դիմելը որևէ կապ չունի վերոհիշյալ խնդրի հետ, քանի որ նախագահը պարտավոր էր ստեղծված իրավիճակում դիմել ՍԴ՝ ՎԱՐՉԱՊԵՏԻ ԱՌԱՋԱՐԿՈՒԹՅՈՒՆԸ Սահմանադրությանը հակասող ճանաչելու պահանջով:
