Пашинян: Оник Гаспарян считается освобожденным от должности начальника Генштаба

Начальник Генштаба ВС РА Оник Гаспарян силой закона считается освобожденным от занимаемой должности. Об этом написал премьер-министр Никол Пашинян на своей странице в Facebook.

 

Он также опубликовал размещенное на официальной странице правительства заявление об освобождении Оника Гаспаряна от должности начальника Генштаба ВС Армении силой закона.

 

«Руководствуясь положениями Конституции РА и закона РА «О военной службе и статусе военнослужащего», премьер-министром РА 25 февраля 2021 г президенту республики было представлено предложение об освобождении от занимаемой должности начальника Генштаба ВС РА Оника Гаспаряна, проект соответствующего указа приложен.

 

27 февраля 2021 г в аппарат премьер-министра поступили возражения президента республики по вышеуказанному проекту.

 

Представленные президентом возражения премьер-министром не были приняты. 28 февраля президенту Армении было направлено письмо с соответствующими обоснованиями.

 

Учитывая то обстоятельство, что в сроки, установленные частью 3 статьи 35.1 закона РА «О военной службе и статусе военнослужащего», президент республики не подписал представленный премьер-министром проект и не обратился в Конституционный суд, принимая за основу часть 3 статьи 139 Конституции РА, а также часть 6 статьи 35.1 закона РА «О военной службе и статусе военнослужащего»  и часть 3 статьи 40 того же закона, с 10 марта начальник Генштаба ВС Армении Оник Гаспарян по закону считается освобожденным от занимаемой должности».
