«Ժողովուրդ»․ ՀՀ նախագահը բորբոքեց կրքերը
POLITICS«Փետրվարի 25-ից մինչ օրս՝ 13 օր, ՀՀ ՊՆ ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանի պաշտոնանկության հարցն այդպես էլ լուծում չի ստանում: Ինչպես հայտնի է, այդ օրը Գլխավոր շտաբը՝ Օնիկ Գասպարյանի գլխավորությամբ, հայտարարություն էր տարածել՝ ասելով թե ԶՈւ սպաները պահանջում են ՀՀ վարչապետ Նիկոլ Փաշինյանի հրաժարականը: Դրանից հետո վարչապետը միջնորդություն էր ներկայացրել նախագահ Արմեն Սարգսյանին՝ Օնիկ Գասպարյանին աշխատանքից ազատելու հարցով, որը մեկ անգամ նախագահն արդեն հետ ուղարկեց Փաշինյանին, սակայն փետրվարի 28-ին նա կրկին նույն միջնորդությունն ուղարկեց Արմեն Սարգսյանին, որը վերջինս ոչ ստորագրեց, ոչ էլ ուղարկեց Սահմանադրական դատարան, և մինչև օրս ԳՇ պետի պաշտոնանկության հարցը հանգուցալուծում չի ստացել:
Բանն այն է, որ «Սահմանադրական դատարանի մասին» սահմանադրական օրենքի 86-րդ հոդվածի («Սահմանադրության 139-րդ հոդվածի 2-րդ մասով նախատեսված հարցերի վերաբերյալ գործերի քննությունր») 1-ին մասին համապատասխան՝ այդ հոդվածում նշված գործերով Սահմանադրական դատարան դիմում է հանրապետության նախագահը իր առարկություններն իրավասու մարմնի կողմից չընդունվելու պահից եռօրյա ժամկետում, եթե գտնում է, որ իրեն ներկայացված առաջարկությունը/ միջնորդությունը հակասում է Սահմանադրությանը:
Նախագահին Սահմանադրությամբ տրված ժամկետն ավարտվել է, քանի որ վերջինս եռօրյա ժամկետում չի դիմել Սահմանադրական դատարան: Եվ, չնայած դրան, տարբեր մասնագետներ այս հարցը տարբեր կերպ էին մեկնաբանում, քանի որ հարց է, թե նախագահը կարող է համապատասխան օրենքի դրույթների սահմանադրականության վիճարկման համար դիմել Սահմանադրական դատարան, այլ ոչ թե հենց վարչապետի միջնորդության մասով, թե ոչ:
Երեկ՝ 18:00-ի դրությամբ, ՀՀ նախագահ Արմեն Սարգսյանն այդպես էլ չէր դիմել Սահմանադրական դատարան»,-գրում է թերթը:
