SOCIETYՀանրային ծառայության մեջ գտնվող անձին վիրավորելու կամ զրպարտելու քրեականացում առաջարկող առկա նախագիծն ընդունվել չի կարող, այն անխուսափելիորեն կհանգեցնի կարծիքի արտահայտման ազատության ոչ իրավաչափ սահմանափակման: Այս մասին ֆեյսբուքյան իր էջում գրել է ՀՀ մարդու իրավունքների պաշտպան Արման Թաթոյանը։
««Հայաստանի Հանրապետության քրեական օրենսգրքում փոփոխություն և լրացում կատարելու մասին» նախագծի ուսումնասիրության արդյունքում Մարդու իրավունքների պաշտպանի իրավական դիրքորոշումները կազմվել են հրատապության սկզբունքով և դրանք կցվում են սույն հայտարարությանը:
Ընդհանուր եզրահանգումն այն է, որ սկզբունքային առումով մտահոգիչ են նախագծի լուծումները հենց միջազգային իրավական այն մոտեցումների հաշվառմամբ, որոնք վիրավորանքի ու զրպարտության ապաքրեականացման պայմաններում առաջարկում են քրեականացնել հանրային ծառայության մեջ գտնվող ցանկացած անձի, այդ թվում, որ առավել անթույլատրելի է՝ քաղաքական ու, առհասարակ, բարձրաստիճան պաշտոն զբաղեցնողների նկատմամբ նման արարքները:
Առավել ևս, կարծիքի արտահայտման ազատության իրավաչափ շրջանակներին համահունչ չեն նման արարքների քրեականացումը՝ պայմանավորված հենց ծառայողական պարտականությունների կատարմամբ: Ասված մտահոգություններն էլ ավելի է ամրապնդում ազատազրկման ձևով պատժի նախատեսումն այն դեպքերում, երբ խնդրո առարկա արարքները կատարվել է զանգվածային լրատվության միջոցներով կամ հրապարակային այլ եղանակով:
Դրանից բացի, նախագծի հիմնավորման մեջ առաջ է քաշվել այնպիսի տրամաբանություն, որը հակասում է միջազգային իրավական մոտեցումներին:
