ՄԻԵԴ-ն անընդունելի է համարել Հայաստանի դեմ Ադրբեջանի քաղաքացու ներկայացրած գանգատը

2021 թվականի փետրվարի 18-ին Մարդու իրավունքների եվրոպական դատարանը հրապարակել է «Սամադովն ընդդեմ Հայաստանի» (գանգատ թիվ 36606/08) գանգատի վերաբերյալ որոշումը: Այս մասին հայտարարություն է տարածել ՄԻԵԴ-ում ՀՀ ներկայացուցիչը:
Սույն գործով դիմումատուն եթադրաբար իրեն սեփականության իրավունքով պատկանող գույք ուներ Քելբաջարի տարածքում և այն լքել էր 1993 թվականին:
Վերջինս Եվրոպական դատարանին գանգատ էր ներկայացրել 2008 թվականին, այն է՝ Մարդու իրավունքների եվրոպական կոնվենցիան Հայաստանի կողմից վավերացվելուց ավելի քան 6 տարի անց: Ավելին,դիմումատուին սեփականության իրավունքով ենթադրաբար պատկանող տնից հարկադիր տեղահանումից անցել էր ավելի քան 15 տարի:
Նման հանգամանքներում Եվրոպական դատարանը, նույնիսկ հաշվի առնելով դիմումատուի փախստականի կարգավիճակը, Կոնվենցիայի վավերացումից վեց տարի անց գանգատի ներկայացումը համարել է չափազանց ուշ:
Եվրոպական դատարանը գանգատը ճանաչել է անընդունելի:
