ՍԴ-ն կքննի Ռոբերտ Քոչարյանի դիմումը. «Հրապարակ»

«Հրապարակ» թերթը գրում է.
Սահմանադրական դատարանը վերջապես կքննի Ռոբերտ Քոչարյանի դիմումը՝ ՀՀ քրօր․ 300․1 հոդվածի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ։ Նիստը նշանակված է մարտի 23-ին։
Հիշեցնենք, որ ՍԴ-ն 2019-ի հուլիսի 18-ին որոշում էր կայացրել՝ կասեցնել Երեւանի ընդհանուր իրավասության դատարանի եւ Ռ․ Քոչարյանի դիմումների հիման վրա՝ ՔՕ 300.1 հոդվածի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ գործերի վարույթները, եւ կարծիքներ ստանալու համար դիմել էր Մարդու իրավունքների եվրոպական դատարան եւ Վենետիկի հանձնաժողով։ Նշված կառույցներից պատասխան ստացվեց անցած ամռանը։ Վենետիկի հանձնաժողովի կարծիքով՝ սահմանադրական կարգի դեմ ուղղված հանցագործությունների ձեւակերպման հարցում միջազգային պրակտիկայում միասնական մոտեցում չկա. պետությունների մի մասում հղումները վերաբերում են Սահմանադրությանն ամբողջությամբ, մյուսներն ուղղակի հղում են կատարում սահմանադրական կարգը պահպանելու անհրաժեշտությանը՝ առանց սահմանելու այն։
Ավելին՝ հուլիսի 7-ին նիստ էր նշանակվել, սակայն ԱԺ-ն ՍԴ-ին միջնորդություն էր ներկայացրել՝ խնդրելով հետաձգել քննությունը, պատճառաբանելով, թե պետք է ծանոթանա Վենետիկի հանձնաժողովի կարծիքին։ Սակայն Քոչարյանի փաստաբանները հայտարարում են, որ իշխանությունները հնարավորինս փորձում են ձգել ՍԴ որոշումը՝ հասկանալով, որ դա լինելու է Քոչարյանի օգտին։ Այնպես որ, գործընթացներն իշխանության օգտին չեն որեւէ հարթակում՝ ո՛չ Մարտի 1-ի դատավարությունում, ո՛չ ՍԴ քննության հարթակում։
