228 հայ գերիներից բացի, կան ենթադրյալ գերեվարման դեպքեր, որոնց քանակը հասնում է մի քան տասնյակի։ Այս մասին NEWS.am-ի հետ զրույցում ասաց Մարդու իրավունքների եվրոպական դատարանում (ՄԻԵԴ) հայ գերիների շահերի ներկայացուցիչ, փաստաբան Սիրանուշ Սահակյանը։
Փաստաբան Սահակյանն ասաց, որ Եվրադատարան ներկայացված 228 հայ գերիների վերաբերյալ հարցումը թե՛ փաստաբանական թիմի, թե՛ լիազոր ներկայացուցչի գրասենյակի կողմից ներկայացված գործերի հանրագումարն է.
«Դրանք ոչ թե Ադրբեջանի կողմից պաշտոնապես հաստատված դեպքերն են, այլ այն դեպքերը, երբ հայկական կողմն ապացույցների հիման վրա Եվրոպական դատարանում հաստատել է գերեվարումը»։
Նա նշեց, որ Ադրբեջանում հայկական կողմը ենթադրյալ այլ գերիներ եւս ունի, որոնց առնչությամբ դեռեւս ուսումնասիրություններ են կատարվում.
«Եթե հավաքվեն բավարար ապացույցներ, ապա այդ գործերը եւս կներկայացվեն ՄԻԵԴ։ Ոչ թե նոր գերեվարումների հետեւանքով է ավելացել գերիների թվաքանակը, այլ նախկինում գերեվարված դեպքեր են բացահայտվել։ Այս պահին ունենք ավելի շատ բացահայտված գերեվարման դեպքեր։ Վստահորեն գերեվարումները վերաբերում են նախորդող ժամանակահատվածին, դեկտեմբերի 13-15-ի դեպքերից հետո ես հայերի նոր գերեվարման դեպքի մասին չգիտեմ»։
Հարցին՝ արդյոք սպասվո՞ւմ է գերիների վերադարձ, Սահակյանը դրական պատասխանեց.
«Գործընթացը շարունակական բնույթ է կրում, կան դրական կանխատեսումներ։ Սակայն հստակ ժամկետներ ու հստակ թիվ չենք կարող ասել»։
Սիրանուշ Սահակյանն ընդգծեց, որ իրավական գործընթացները կարեւոր են եւ իրենց նշանակությունն ունեն այս գործընթացում.
«Մենք գիտենք, որ անմիջականորեն հայ-ադրբեջանական բանակցությունների արդյունքում խնդիրը չի լուծվել։ Գործընթացը, այնուամենայնիվ, տապալված չէ, ունենք այստեղ գործընկերներ ի դեմս՝ Ռուսաստանի Դաշնության»։
Սահակյանի խոսքով՝ միջազգային մի շարք կառույցների նույնպես հետաքրքրում է գերիների վերադարձի հարցը, որը չի կարող դրական ազդեցություն չունենալ։
«Քաղաքական ձեւաչափի առնչությամբ կա նաեւ ինքնախոստովանություն, թերեւս իրենք կմեկնաբանեն՝ ինչպես պատահեց, որ խնդիրը քաղաքականացվեց, դարձավ բանակցություններում սակարկությունների առարկա եւ հնարավոր չեղավ մարդասիրական նկատառումներից ելնելով այն անհապաղ լուծել։ Մենք դեռեւս կարեւորում ենք քաղաքական պրոցեսները»,- նշեց նա։
Անդրադառնալով ԵԽԽՎ-ի կողմից ռազմագերիների հարցի փոխարեն Նավալնու ձերբակալման հարցի քննարկմանը՝ փաստաբան Սահակյանը նշեց.
«Եվրոպայի խորհուրդը քաղաքական մարմին է։ Պատվիրակությունների աշխատանքը նշանակություն ունի. որքան պրոակտիվ են օրակարգային հարցեր առաջ քաշելու գործում, եւ ինչպես են կարողանում փոխհարաբերվել գործընկեր երկրների պատվիրակությունների հետ, որպեսզի քվեարկությունների ընթացքում ստանան աջակցություն։ Եթե այս խնդիրները չեն դառնում օրակարգային, ուրեմն, իհարկե, թերացումներ կարող ենք արձանագրել։ Նաեւ Եվրոպայի խորհուրդն ունի իր հետաքրքրությունները։ Եթե օրակարգ է մտնում մի հարց, որտեղ կառույցն ինքնին ունի շահեր, ինքն է առաջատար դառնում խնդիրներ քննարկելու գործում»։
