ԱԺ-ն հաստատեց Դատական օրենսգրքում աղմկահարույց փոփոխությունները

ՀՀ ազգային ժողովը երկրորդ ընթերցմամբ և ամբողջությամբ ընդունեց կառավարության կողմից ներկայացված օրենքի նախագիծը, որով առաջարկվում է ներդնել մինչդատական վարույթի նկատմամբ դատական վերահսկողության գործերով առանձին ենթամասնագիտացում ունեցող դատավորների ինստիտուտ: «Հայաստանի Հանրապետության դատական օրենսգիրք» սահմանադրական օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին և կից ներկայացված օրենքների նախագծերի փաթեթն ԱԺ նիստում ստացավ 83 կողմ, 24 դեմ, 1 ձեռնպահ ձայներ:
Նախագծերի փաթեթով առաջարկվում է մինչդատական վարույթի նկատմամբ դատական վերահսկողության գործերով առանձին ենթամասնագիտացում ունեցող դատավորների ինստիտուտի ներդրումը: Նախագծով նախատեսվում է, որ Երևան քաղաքի ընդհանուր իրավասության դատարանում առանձին դատավորներ, որոնք ունեն քրեական մասնագիտացում, քննելու են մինչդատական վարույթի նկատմամբ դատական վերահսկողության գործերը և ՀՀ տարածքում իրականացվող օպերատիվ-հետախուզական միջոցառումների թույլտվության միջնորդությունները, օրինակ` խուզարկության սանկցիաները, կալանքի հետ կապված սանկցիաները, ձերբակալման իրավաչափության հետ կապված գործերը և մի շարք այլ միջնորդություններ և բողոքներ, որոնք բնորոշ են մինչդատական վարույթի փուլին: Մարզերում քրեական մասնագիտացում ունեցող դատավորները, ի լրումն իրենց կողմից քննվող քրեական գործերի, կրկին մասնագիտանալու են մինչդատական վարույթի նկատմամբ դատական վերահսկողության գործերով:
ՀՀ արդարադատության նախարար Ռուստամ Բադասյանը նշել էր, որ այդ նպատակով դատական համակարգում ավելացվում է առնվազն 17 հաստիք, որոնցից առնվազն 8-ը՝ Երևանում: «Վերաքննիչ դատարանում ընդհանուր առմամբ վեց դատավոր կրկին մասնագիտանալու է մինչդատական վարույթի նկատմամբ դատական վերահսկողության գործերով՝ ի լրումն իրենց կողմից քննվող քրեական գործերի»,-ասել էր նախարարը:
Առաջինից երկրորդ ընթերցմամբ քննարկմանը նախագծում արվել է 3 փոփոխություն, որոնք կոնցեպտուալ բնույթ չունեն: Եվս 2 փոփոխություններից մեկը վերաբերվում է դատավորների հայտարարագրերը վերլուծելուն, սահմանվում է 1 ամիս ժամկետ, մյուսը տերմինաբանական բնույթի փոփոխություն է:
