Արդարադատության նախարարությունն առաջարկում է լրացում կատարել «Դատական ակտերի հարկադիր կատարման մասին» օրենքում։

Նշվում է, որ մեր երկրում 2020 թ.-ի սեպտեմբերի 27-ին հայտարարված ռազմական դրությամբ պայմանավորված՝ պարտատերերը, այդ թվում՝ բանկերը և վարկային կազմակերպությունները, համապատասխան հիմքերի առկայության պարագայում կարող են ներել որոշ պարտապանների (օրինակ՝ զոհված, հաշմանդամ դարձած, անհայտ բացակայող կամ մահացած ճանաչված անձանց) պարտավորությունները: Մինչդեռ, հնարավոր են դեպքեր, երբ պարտատերերը ներում են պարտապանների այն պարտավորությունները, որոնց վերաբերյալ արդեն իսկ հարուցվել են կատարողական վարույթներ, որի դեպքում գանձվում են կատարողական գործողությունների կատարման ծախսեր:

Այսինքն՝ օրենքի ներկայիս կարգավորմամբ պարտատերը, այդ թվում՝ բանկը և վարկային կազմակերպությունը, ռազմական դրության իրավական ռեժիմով և որոշակի հանգամանքներով պայմանավորված, եթե ներում է պարտապանի պարտավորությունը, ապա ցանկացած դեպքում կատարողական ծախսերը գանձվում են հարկադիր կատարողի կողմից: Արդարադատության նախարարության կողմից ներկայացված նախագծի ընդունմամբ հնարավորություն կտրվի հարկադիր կատարումն ապահովող ծառայությանը կատարողական ծախսեր չգանձել Հայաստանի Հանրապետության պաշտպանության մարտական գործողություններին մասնակցելու, հակառակորդի հետ շփման գծում մարտական հերթապահություն կամ հատուկ առաջադրանք կատարելու ժամանակ, հակառակորդի նախահարձակ գործողության հետևանքով զոհված, հաշմանդամ դարձած, անհայտ բացակայող կամ մահացած ճանաչված անձի, նրա ամուսնու, զավակի կամ ծնողի վերաբերյալ հարուցված կատարողական վարույթները կարճվելու դեպքում:
