Գագիկ Ջհանգիրյանը չի համապատասխանում ԲԴԽ անդամի թեկնածուի պահանջներին. օրենք կփոխե՞ն. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է.

Գագիկ Ջհանգիրյանի՝ ԲԴԽ անդամ կամ նախագահ դառնալու լուրը դատական համակարգում տհաճ խոսակցությունների պատճառ է դարձել:

Տարբեր դատարանների դատավորներ հավաքվել եւ քննարկել են այն հարցը, թե ինչու է Գագիկ Ջհանգիրյանը խնդիր դրել իր առջեւ մտնել ԲԴԽ, եւ ինչպես է իշխանությունը նրան հանձնարարել ԲԴԽ-ին իր բուռը հավաքել ու «լուծել վնգստացողների» հարցը։

«Ժողովուրդ» օրաթերթին դատավորների հավաքից ու խոսակցությունից մանրամասներ են հայտնի դարձել: Պարզվում է՝ «վնգստացողների» հարցերը լուծելու համար իշխանությունները որոշել են նաեւ օրենքը շրջանցել։

Մասնավորապես, դատավորները առաջ են քաշել Ջհանգիրյանի տարիքի հարցը: Դատական օրենսգրքի 80-րդ հոդվածի 9-րդ կետը, որը նկարագրում է ԲԴԽ անդամներին ներկայացվող պահանջները, հաստատում է, որ Ազգային ժողովի կողմից որպես Բարձրագույն դատական խորհրդի անդամ չի կարող ընտրվել այն անձը, որն ունի օրենքով դատավոր նշանակվելու համար սահմանված որեւէ սահմանափակում:

Նույն օրենսգրքի 97-րդ հոդվածը, որը սահմանում է դատավորի թեկնածուի հավակնորդին ներկայացվող պահանջները, հենց 1-ին կետով նշում է, որ դատավորի թեկնածուների հավակնորդների ցուցակում ընդգրկվելու համար որակավորման ստուգմանը կարող են մասնակցել 25-60 տարեկան, ընտրական իրավունք ունեցող անձինք:

Իսկ, ահա, Գագիկ Ջհանգիրյանը ծնվել է 1955 թվականին եւ 66 տարեկան է, այսինքն՝ 6 տարի մեծ է պահանջվող տարիքային շեմից։ Ստացվում է, որ Գագիկ Ջհանգիրյանը դատավոր չէ, իսկ ԲԴԽ անդամի կարգավիճակը հավասարեցված է դատավորի կարգավիճակին, սակայն, փաստորեն, նա դատավոր էլ չի կարող ընտրվել տարիքային սահմանափակման պատճառով:

Ուստի ելքը մնում է այն, որ ԱԺ-ն՝ իր գրպանային մեծամասնությամբ, Ջհանգիրյանի համար օրենք պիտի փոխի։ Սա դատավորները համարել են անթույլատրելի եւ նախկիններից չտարբերվող քայլ, ուստի որոշել են սպասել՝ հասկանալու համար, թե ինչ քայլերի կգնան քաղաքական իշխանությունները հանուն Գագիկ Ջհանգիրյանի: Դատավորներից շատերն էլ նաեւ հիշել են Մատաղիսի հայտնի գործը եւ նշել, թե ինչպես է նախկին զինդատախազը դատավորներին իր բուռը հավաքելու, երբ դատավորները շատ լավ գիտեն նրա «կարած» գործերի մասին:

Ինչեւէ, հավաքի վերջում դատավորները կարծիք են հայտնել, որ ո՛չ Գագիկ Հարությունյանին, ո՛չ Ռուբեն Վարդազարյանին չի հաջողվել իրենց «կանոններ թելադրել կամ բուռը հավաքել», ուստի Գագիկ Ջհանգիրյանը թող այդ «հովերով» չգա, քանի որ դա նրան եւս չի հաջողվի: Հավելենք, որ այսօր ԱԺ «Իմ քայլը» խմբակցության անդամները խորհրդարանում կհանդիպեն Ջհանգիրյանին եւ կքննարկեն նրա թեկնածության հարցը:
