Շիրակի մարզից գերեվարված 62 քաղաքացու կյանքի և առողջության երաշխիքների ապահովման համար ԽԿԿ դիմում է ուղարկվել

ԱԺ «Իմ քայլը» խմբակցության պատգամավոր Նազելի Բաղդասարյանը ֆեյսբուքյան իր էջում գրում է․
«Շիրակի մարզից գերեվարված 62 քաղաքացու կյանքի և առողջության երաշխիքների ապահովման համար այսօր դիմել եմ Եվրոպայի խորհրդի խոշտանգումների կանխարգելման կոմիտե (ԽԿԿ, CPT)։
Նախագահ Միկոլա Գնատովսկուն ուղղված նամակում կոչ եմ արել ձեռնարկել անհրաժեշտ միջոցներ եւ հնարավորության դեպքում իրականացնել հրատապ (ad hoc) այց Ադրբեջանի փակ հաստատություններում պահվող գերեվարված անձանց պայմանների մոնիտորինգ իրականացնելու համար։
Միջազգային մարդասիրական իրավունքի նորմերի համաձայն ռազմական գործողությունների ավարտից հետո գերեվարված անձինք կյանքի, ֆիզիկական և հոգեկան առողջության անձեռնմխելիության իրավունք ունեն։ Գերեվարվածները բոլոր հանգամանքներում պետք է օգտվեն պաշտպանությունից և արժանանան մարդասիրական վերաբերմունքի առանց որևէ խտրականության։ Պետք է երաշխավորվի ընտանիքի անդամների հետ նամակագրության և օգնություն ստանալու իրավունքը։
Հիշեցնեմ, որ ավելի վաղ Հայաստանի կառավարությունը՝ ի դեմս ՄԻԵԴ-ում Հայաստանի ներկայացուցչի, ինչպես նաև առանձին իրավապաշտպաններ մեր 62 հայրենակիցների հարցով դիմել էին ՄԻԵԴ։ Մարդու իրավունքների եվրոպական դատարանը հրատապ միջանկյալ միջոց էր կիրառել այս հարցով։ Ցավով պետք է արձանագրեմ, որ նշված ժամկետը՝ դեկտեմբերի 28-ը, որի ընթացքում Ադրբեջանը պետք փոխանցեր տեղեկատվություն ռազմագերիների վերաբերյալ, բժշկական փաստաթղթեր տրամադրեր եւ վերջիններիս փոխանակման ժամկետներ հայտներ, խախտվել է։
Ուստի, հաշվի առնելով ադրբեջանական իշխանությունների բացահայտ արհամարհական վերաբերմունքը իրավական գործընթացների և հատկապես Եվրոպական դատարանի որոշումների նկատմամբ, ինչպես նաև Դատարանի որոշումներում սահմանված ժամկետների բազմակի խախտումները և Ադրբեջանի նախագահի վերջին հայտարարությունները՝ Հայաստանը հունվարի 3-ին և 5-ին դիմել է Եվրոպական դատարան՝ պահանջելով ադրբեջանական խախտումների վերաբերյալ հարցը ներկայացնել ԵԽ Նախարարների կոմիտե՝ Դատարանի կանոնների 39 -ի 2-րդ դրույթի հիման վրա։
Խոշտանգումների և անմարդկային կամ արժանապատվությունը կամ պատժի կանխարգելման կոմիտեին (ԽԿՀ, CPT) ուղղված այսօրվա իմ նամակը ևս մեկ լրացուցիչ միջոց է, որը Եվրոպական դատարանի գոյություն ունեցող դատական մեխանիզմի հետ մեկտեղ հուսանք կկիրառվի որպես կանխարգելիչ և ոչ դատական մեխանիզմ։ Քանզի ԽԿԿ-ն Եվրոպայի խորհրդի մարդու իրավունքների պաշտպանության համակարգի անբաժանելի մասն է կազմում։
Հարկ եմ համարում եւս մեկ անգամ հորդորել բոլորին սոցիալական ցանցերում ռազմագերիների անունների և այլ անհատական տվյալների հրապարակումից զերծ մնալ»։
