Այս տարվա ընթացքում դատական համակարգը ցույց տվեց, որ քաղաքական իշխանության կամքից անկախ է գործում: Այս մասին Tert.am-ի հետ զրույցում ասաց փաստաբան Երվանդ Վարոսյանը՝ հավելով, որ իշխանությունների պարտադրանքը, դատական համակարգի նկատմամբ բիրտ վերաբերմունքը հանգեցրեց դիմադրության:

«Դիմադրությունը ոչ թե օրենքի դաշտից դուրս է, այլ փորձում են մնալ օրենքի դաշտի շրջանակում և քաղաքական պատվերներ չկատարել»,-ասաց նա:

Երվանդ Վարոսյանի խոսքով՝ առհասարակ եղել են դեպքեր, որ կոնկրետ դատավորներ քաղաքական պատվերներ կատարել են, արժանացել սուր քննադատությունների, բայց այժմ դատական համակարգն իր դիմակայությամբ կանխում է մի շարք ապօրինություններ:

«Հիմա իշխանությունների կողմից Հայաստանն ապամոնտաժելու գործողությունների շղթա է իրականացվում, սա է, որ դատավորներին ստիպում է այս ամենի մասնակիցը չդառնալ: Քաղաքական իշխանությունը խնդիր է դրել Հայաստանն աշխարհագրական քարտեզից վերացնել, և այդ ճանապարհին նաև քայլերից մեկը քաղաքական ընդդիմախոսներին լռեցնելն է՝ քրեական հետապնդումների միջոցով։ Բնական է, որ այն դատավորները, որոնք կհամաձայնեն կնքել այդ հետապնդումները, ևս հակապետական քայլ են անելու, և դա է պատճառը, որ շատ մարդիկ պատրաստ չեն այդ քայլին գնալ»,-ասաց նա:

Անդրադառնալով հարցին, թե դատական համակարգը կարող է դիմադրել, իշխանությունները տարբեր քայլեր են ձեռնարկում՝ օրենսդրական նախաձեռնությունների տեսքով նաև, բացի այդ, նախորդ տարի Նիկոլ Փաշինյանը հրավիրել էր դատարանների նախագահներին, Երվանդ Վարոսյանն ասաց.

«Մենք և դատական համակարգը պետք է դիտարկենք այնքան, ինչքան կարող ենք, նահանջի տեղ Հայաստանում այլևս ոչ ոք չունի: Սա արդեն մեր երկրի գոյության, ապրելու հնարավորության համար պայքար է: Կա՛մ մենք դառնալու ենք Մոսկվաներում, Ռոստովներում գաղթականներ, կա՛մ դիմադրելու ենք, պայքարելու ենք: Հենց որ ընկճվենք բոլորս, այդ թվում՝ դատավորները, ընտրելու ենք գաղթի ճանապարհը: Այլ տարբերակ չկա: Այո՛, Նիկոլ Փաշինյանը փորձելու է ինչ-որ օրենսդրական փոփոխություններ անել, բայց, իմանալով իր թիմի մակարդակը՝  չեն էլ կարողանա նորմալ ձևով անել, փորձելու են ստեղծել իրենց գրպանային հատուկ դատարանը, բայց դրա դեմ պետք է առնենք, նորից եմ կրկնում՝ սա արդեն ապրելու իրավունքի հարց է»,-ընդգծեց Երվանդ Վարոսյանը:

Փաստաբանն անդրադարձավ նաև շրջանառվող տեսակետներին, որ դատական համակարգում շատերը սպասում են, որ Նիկոլ Փաշինյանը հայտնվի ամբաստանյալի կարգավիճակում:

«Դատավորներն իրենց ցանկություններով չեն առաջնորդվում, երբ որ կլինի համապատասխան քրեական գործ՝ բնականաբար, օրենքի շրջանակում, այդ ամենին գնահատական կտան: Նիկոլ Փաշինյանի շուտափույթ հեռացմանը սպասում ենք բոլորս, հասարակության մեջ ցանկացած գիտակից անհատ էլ նրա հեռացմանն է սպասում, իսկ թե կհայտնվի ամբաստանյալի աթոռին, թե ոչ, քննությունը պիտի ցույց տա, բայց այն, որ քննություն պիտի իրականացվի, դա փաստ է, Նիկոլ Փաշինյանի պաշտոնավարման օրոք քննություն իրականացնել պարզապես չեն կարողանա,  նրա պաշտոնավարման օրոք կարող են լինել միայն ծածկադմփոցներ»,-մանրամասնեց նա:
