ՀՀ ԱԳՆ-ն ՄԻՊ-ին է տրամադրել սահմանագծման և սահմանազատման գործընթացների հետ կապված պաշտոնական դիրքորոշում
POLITICSՀայաստանի մարդու իրավունքների պաշտպանի աշխատակազմը հայտնում է, որ Հայաստանի Հանրապետության արտաքին գործերի նախարարությունը Պաշտպանին է տրամադրել սահմանագծման և սահմանազատման գործընթացների հետ կապված պաշտոնական դիրքորոշում:
«Հայաստանի Սյունիքի մարզ կատարած այցի արդյունքներով Մարդու իրավունքների պաշտպանը պաշտոնական հարցում էր ուղարկել ՀՀ արտաքին գործերի նախարարություն` կապված սահմանագծման և սահմանազատման գործընթացների հետ` հաշվի առնելով ստեղծված իրավիճակում մարդու իրավունքների վրա այդ գործընթացների ուղիղ ազդեցությունը:
ՀՀ ԱԳՆ-ն տրամարդել է կարևոր նշանակության պաշտոնական դիրքորոշում: Ստորև այն հրապարակում եմ ամբողջությամբ.
«Պետական սահմանների սահմանագծումը (դելիմիտացիան) և սահմանազատումը (դեմարկացիան) հաջորդաբար իրականացվող երկկողմ միջազգային գործընթացներ են, որոնք պահանջում են համատեղ հանձնաժողովի առկայություն և դրա շրջանակներում մասնագիտական քննարկումների և բանակցությունների անցկացում։ Վերոնշյալ գործընթացների առաջնային պայման է սահմանակից պետությունների միջև երկկողմ բնականոն, այդ թվում` դիվանագիտական հարաբերությունների առկայությունը:
Միջազգային պրակտիկայում՝ սահմանակից երկրների միջև սահմանագծման և սահմանազատման գործընթացներն իրականացնելու նպատակով ձևավորվում է համապատասխան երկկողմ միջկառավարական հանձնաժողով (երկրների արտաքին քաղաքական գերատեսչությունների ներկայացուցիչների գլխավորությամբ)՝ բաղկացած պետական շահագրգիռ մարմինների (արտաքին քաղաքական, պաշտպանության և անվտանգության ոլորտներից) ներկայացուցիչներից և փորձագետներից (մասնավորապես՝ գեոդեզիայի և քարտեզագրության ոլորտից)։
Նման հանձնաժողովների աշխատանքների առաջին փուլը, որպես կանոն, ավարտվում է առանձին երկկողմ համաձայնությամբ՝ սահմանագծման իրավական հիմքերի շուրջ, հետագայում՝ սահմանագծման ավարտից հետո, նաև սահմանազատման գործընթացի համատեղ իրականացման շուրջ։
Հանձնաժողովի կողմից երկկողմ գործընթացի բարեհաջող ավարտից հետո կնքվում է երկու պետությունների միջև սահմանի մասին համաձայնագիր, որով արձանագրվում է սահմանային հարցերում բոլոր խնդիրների լուծված լինելու հանգամանքը։
Նախքան վերոնշյալ գործընթացների մեկնարկը և դրանց բարեհաջող ավարտը՝ պետական սահմանի երկայնքով մարտական հերթապահություն իրականացնելու նպատակով զինված ուժերի կամ սահմանապահ զորքերի տեղակայումը բացառապես պաշտպանական և անվտանգային բնույթի միջոցառում է՝ կողմերի փաստացի վերահսկողության տակ գտնվող բնագծերում, որը անմիջականորեն կամ միջնորդավորված բանակցվում է զինված ուժերի ներկայացուցիչների միջև:
Ուստի, ներկայումս ընթացող միջոցառումների իրականացումը չի առնչվում կարգավիճակային հարցերին, չի կարող մեկնաբանվել որպես սահմանագծման և սահմանազատման շուրջ վերջնական համաձայնություն կամ գոյություն ունեցած վարչական սահմանների մեխանիկական հաստատում»:
Ինչպես նշված, այնպես էլ տաբեր այլ հարցերով ՀՀ ԱԳՆ հետ, հատկապես միջազգային կառույցներում մեր երկրի մշտական ներկայացուցիչների, մի շարք պետություններում մեր դեսպանների հետ Հայաստանի մարդու իրավունքների պաշտպանի հաստատությունն ունի հաստատված արդյունավետ համագործակցություն ու վստահելի գործընկերային աշխատանք»:
