Կպահպանվեն միջազգային փաստաթղթերի պահանջները

Մարինա Ներսեսյանը Ֆեյսբուքյան իր էջում գրում է.
Ընտանիքի և արտաքին աշխարհի հետ դատապարտյալների կապն ապահովելու անհրաժեշտությունն ամրագրված է ՀՀ քրեակատարողական օրենսգրքի 92- րդ հոդվածում, որի համաձայն քրեակատարողական հիմնարկներում կազմակերպվում և անցկացվում են կարճատև և երկարատև տեսակցություններ: Նույն հոդվածի 2- րդ մասով նախատեսվում է դատապարտյալին 1 ամսվա ընթացքում տրամադրել առնվազն 1 կարճատև տեսակցություն մինչև 4 ժամ տևողությամբ և 2 ամսվա ընթացքում առնվազն 1 երկարատև տեսակցություն` մինչև 3 օր տևողությամբ:
Առանձնապես ծանր հանցագործության համար որոշակի ժամկետով կամ ցմահ ազատազրկված անձանց տեսակցությունը սահմանափակ է` տարվա ընթացքում առնվազն 3 կարճատև և մեկ երկարատև տեսակցություն: Այսպիսով ստացվում է, որ խաթարված է վերջիններիս կապն ընտանիքի և արտաքին աշխարհի հետ, ինչը կարող է բազմաթիվ հոգեբանական խնդիրներ հարուցել: Մինչդեռ տեսակցության իրավունքը դասվում է բանտարկյալների հիմնարար իրավունքների շարքը, և այդ դրույթը նշված է ՄԱԿ- ի առաջին կոնգրեսի ընդունած Բանտարկյալների հետ վարվեցողության նվազագույն ստանդարտ կանոններում, Եվրոպայի խորհրդի նախարարների կոմիտեի «Եվրոպական բանտային կանոնների մասին» հանձնարարականում, Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին» եվրոպական կոնվենցիայում և այլ միջազգային փաստաթղթերում:
Նկատի առնելով այս ամենը, ՀՀ կառավարությունն իր ս.թ. դեկտեմբերի 10- ի նիստում հավանություն է տվել ՀՀ քրեակատարողական օրենսգրքում փոփոխություն և լրացում կատարելու օրենքի նախագծին, որով առաջարկվում է օրենսգրքի 92- րդ հոդվածի 2- րդ մասը լրացնել նոր խմբագրությամբ` առանձնապես ծանր հանցագործության համար որոշակի ժամկետով կամ ցմահ ազատազրկման դատապարտված անձանց, եթե նրանք կրել են նշանակված պատժի 10 տարին, տրամադրել հավելյալ` տարեկան առնվազն 6 կարճատև և երկու երկարատև տեսակցություն:
ՀՀ Ազգային ժողովում օրենքի փոփոխությունն ընդունելու դեպքում կպահպանվեն միջազգային բազմաթիվ փաստաթղթերի պահանջները, կամրապնդվեն դատապարտյալների ընտանիքի և արտաքին աշխարհի հետ կապերը, կմեծանա դատապարտյալների հետ տարվող աշխատանքի արդյունավետությունը: Ի վերջո, տեսակցությունների թվի ավելացումը կդառնա ազատազրկված անձանց օրինապահ վարքագծի դրսևորման լրացուցիչ խթան:
