Զորակոչված և կամավորական սկզբունքով հայրենիքի պաշտպանությանը մասնակցող քաղաքացիների աշխատատեղերը կպահպանվեն, այդ ժամանակահատվածը կհաշվարկվի որպես աշխատանքային ստաժ:
Այս և մի շարք այլ փոփոխություններ սահմանող «Հայաստանի Հանրապետության աշխատանքային օրենսգրքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքը ՀՀ ազգային ժողովի կողմից երկրորդ ընթերցմամբ և ամբողջությամբ ընդունվել է 2020 թ. հոկտեմբերի 9-ին:
Սեպտեմբերի 27-ից Ադրբեջանի կողմից սանձազերծված լայնամասշտաբ ռազմական գործողությունների հետևանքով Հայաստանի Հանրապետությունում հայտարարված ռազմական դրությամբ պայմանավորված՝ «Հայաստանի Հանրապետության աշխատանքային օրենսգրքում» կատարվել են լրացումներ և փոփոխություններ, որոնցով զորահավաքային զինվորական ծառայության անցած, ինչպես նաև՝ որպես կամավորական մարտական գործողություններին մասնակցող, աշխատողների համար սահմանվել են հետևյալ երաշխիքները՝
- պահպանվելու է իրենց աշխատատեղը,
- այդ ժամանակահատվածը ներառվելու է իրենց աշխատանքային ստաժում,
- այդ ժամանակահատվածի համար իրենց համար կուտակվելու է ամենամյա արձակուրդի օրեր,
- բացի պետական բյուջեից տրվող վարձատրության, կողմերի համաձայնությամբ, կարող են վարձատրվել նաև գործատուի կողմից,
- միջին աշխատավարձի չափի հաշվարկի վրա չի ազդելու գործատուի կողմից տրվող վարձարտրության չափը,
- վերը նշված երաշխիքներն ունենալու են հետադարձ ուժ՝ սկսած Հայաստանի Հանրապետություն ռազմական դրություն հայտարարելու օրվանից։
Միաժամանակ, պետական հատվածի՝ ռազմական դրության աշխատանքային ռեժիմի փոխադրմամբ պայմանավորված, իրենց աշխատանքներն անխափան իրականացնելու նպատակով, սահմանվել են, որ ռազմական դրության ժամանակահատվածում՝
- աշխատանքի վայրի փոփոխությունը չի համարվելու աշխատողի համար աշխատանքի էական պայմանի փոփոխություն,
- աշխատանքի վայրի փոփոխություն դեպքում աշխատողը նախապես չի ծանուցվելու,
- ամենամյա արձակուրդի մեջ գտնվող աշխատողին արձակուրդից հետ կանչելիս աշխատողի համաձայնությունը չի պահանջվելու,
- արտաժամյա, գիշերային և աշխատանքային ժամանակացույցով չնախատեսված՝ հանգստյան ու օրենքով սահմանված ոչ աշխատանքային՝ տոնական և հիշատակի օրերին, կատարված աշխատանքի համար աշխատողին չի վճարվելու հավելում։
Օրենքով հստակեցվել են նաև, թե զորահավաքային զինվորական ծառայության անցած, ինչպես նաև՝ որպես կամավորական մարտական գործողություններին մասնակցող աշխատողները ինչպիսի փաստաթղթերի ներկայացման դեպքում են կարող ազատվել աշխատանքային պարտականությունների կատարումից։
