«Ժողովուրդ» թերթը գրում է․ «Արդեն երկու օր է՝ Սահմանադրական դատարանի անդամները չեն կարողանում նախագահ եւ փոխնախագահ ընտրել: Երեկ Սահմանադրական դատարանի նախագահի պաշտոնում ինքնաառաջադրվեց Երվանդ Խունդկարյանը, իսկ ՍԴ նախկին նախագահ Հրայր Թովմասյանն էլ առաջադրեց Աշոտ Խաչատրյանի թեկնածությունը, սակայն քվեարկություն այդպես էլ տեղի չունեցավ:

Ավելին, «Ժողովուրդ» օրաթերթի տեղեկություններով, ամենայն հավանականությամբ, ընտրության ելքը կանխորոշվելու է երկրորդ փուլով: Բանն այն է, որ «Սահմանադրական դատարանի մասին» ՀՀ օրենքի համաձայն՝ Սահմանադրական դատարանի կազմից նախագահ կարող է ընտրվել այն թեկնածուն, որը ստացել է դատավորների ընդհանուր թվի ձայների երկու երրորդը: ՍԴ-ն ունի 9 անդամ, ստացվում է՝ այս կամ այն թեկնածուն պետք է ստանա 6 ձայն, որպեսզի դառնա կառույցի նախագահ, ինչն այնքան էլ իրատեսական չէ: Եվ այդ դեպքում, եթե ոչ ոք քվեարկության արդյունքով չի ստանում անհրաժեշտ թվով ձայներ, ապա հնգօրյա ժամկետում անցկացվում է ընտրության երկրորդ փուլ, որի ժամանակ նախագահ է դառնում այն անձը, որը ստացել է Սահմանադրական դատարանի դատավորների ձայների ընդհանուր թվի մեծամասնությունը։ Եվ չնայած Աշոտ Խաչատրյանը հանեց իր թեկնածությունը, սակայն հարց է՝ ինչպես կդասավորվեն ձայները: Այստեղ ամեն ինչ կախված է Արայիկ Թունյանից եւ Աշոտ Խաչատրյանից, թե ինչպես կքվեարկեն նրանք:

Ասել է թե՝ Խունդկարյանի ճակատագիրը կախված է այս երկու անձանց քվեարկությունից, իսկ, ահա, ՍԴ մեր աղբյուրները պնդում են, որ Թունյանը եւ Խաչատրյանը մշտապես անկանխատեսելի են եղել իրենց որոշումներում, ուստի պարզ չէ, թե այսօր ինչպես կքվեարկեն:

Եվ չնայած Սահմանադրական դատարանի կազմն արդեն ամբողջական է, եւ կառույցը պետք է սկսի գործել, սակայն արդեն պարզ է, որ առաջիկայում նոր իրավիճակի եւ խնդիրների ենք բախվելու: Կանխատեսվում է, որ հետագայում եւս Սահմանադրական դատարանում քննվող յուրաքանչյուր հարցի ժամանակ լարվածություն է ստեղծվելու, եւ ներկաներից յուրաքանչյուրը փորձելու է ցույց տալ, թե ինքը պրոֆեսիոնալ է, միակ ճշմարիտը, եւ արդյունքում ականատես ենք լինելու հարցերի վերաբերյալ երկար-բարակ, անբովանդակ քննարկումների»։
