Որեւէ առաջադրում իմ կողմից չի կատարվելու, ինքնաառաջադրում չի կատարվելու: Այս մասին այսօր՝ սեպտեմբերի 23-ին, ՍԴ-ի դիմաց լրագրողների հետ զրույցում նշեց ՍԴ դատավոր Արեւիկ Պետրոսյանը՝ անդրադառնալով ՍԴ նախագահի ընտրությանը, որը կայանալու է այսօր՝ աշխատակարգային նիստում:

Հարցին, թե ում ինքը կտա իր ձայնը, ՍԴ դատավորն ասաց. «Դեռ այս պահին չկան առաջադրված թեկնածուներ: Կտեսնենք, թե ովքեր կառաջադրեն իրենց թեկնածությունը, ինչպիսի ելույթներ կունենան, ինչպիսի տեսլական են պատկերացնում, ինչպիսի գնհատական կտան ստեղծված իրավիճակին, ինչպես կպատկերացնեն ստեղծված իրավիճակի հանգուցալուծումները, ըստ այդմ  կլինի իմ մոտեցումն ու դիրքորոշումը»,-ասաց նա:

Դիտարկմանը, որ ՍԴ նիստեր տեղի չեն ունենում նաեւ այն պատճառով, որ ինքն ու Հրայր Թովմասյանը չեն մասնակցում նիստերին, Արեւիկ պետրոսյանն ասաց. «ՍԴ-ում առ այս տարվա հունիսի 26-ը, այսինքն  մինչեւ սահմանադրական փոփոխությունների ուժի մեջ մտնելը որեւէ խնդիր չի եղել քվորումի, իրավազորության հետ կապված: ՍԴ-ում ստեղծված իրավիճակի վերաբերյալ երեք խումբ հարցեր են եղել, որոնց վերաբերյալ ես իմ հանրային կարծիքը ներկայացրել եմ: Դրանք պայմանավորված են սահմանադրական փոփոխություններով, ՍԴ-ի մասին օրենքի փոփոխություններով եւՍԴ բնականոն գործունեության կազմակերպման հետ կապված հարցերով: Այդ հարցերը հանգամանալից, մանրամասն ներկայացվել է: Որեւէ քայլ չի կատարվել, որպեսզի խնդիրը հանգուցալուծվի: Մինչեւ հիմա սպասում ենք, որ այդ հարցերն իրենց լուծումները ստանան եւ ՍԴ-ն իր սահմանադրական առաքելությունն իրականացնի»:

Հիշեցնենք, որ Սահմանադրական դատարանի դատավորներն այսօր՝ սեպտեմբերի 23-ին իրենց աշխատակարգային նիստում ՍԴ նախագահ եւ փոխնախագահ պետք է ընտրեն:

«Սահմանադրական դատարանի մասին» ՀՀ օրենքի հոդված 19-ի համաձայն, Սահմանադրական դատարանի կազմից նախագահ կարող է ընտրվել այն թեկնածուն, որը ստացել է դատավորների ընդհանուր թվի ձայների (9) երկու երրորդը, իսկ այն դեպքում, երբ առաջադրվել է մեկ թեկնածու, ապա ընտրվում է դատավորների ընդհանուր թվի ձայների մեծամասնությամբ: Այսինքն ՍԴ նախագահն ընտրվելու է կամ 5 կամ 6 ձայներով:

Մինչեւ վերջին պահը ինտրիգը պահպանվում է, թե ով է լինելու ՍԴ նախագահ: Ըստ մամուլի տեղեկությունների Երվանդ Խունդկարյանը ՍԴ է եկել նախագահ դառնալու ակնկալիքով, սակայն նրա թեկնածությունը միանշանակ չի ընկալվում: Հնարավոր է թեկնածու առաջադրվի նաեւ Արման Դիլանյանը, իսկ այդ դեպքում շատ հավանական է, որ թեկնածուներից  ոչ մեկը չստանա 6 ձայն: Նման սցենարի դեպքում տեղի կունենա երկրորդ փուլ, որտեղ թեկնածուներից քիչ ձայն ստացածը դուրս կգա մրցակցությունից, մնացողն արդեն կընտրվի 5 ձայնով։ Իսկ եթե երկրորդ փուլում էլ չհաջողվի նախագահ ընտրել, ապա, ըստ օրենքի, 10 օր անց նոր ընտրություն կկայանա։
