«Հրապարակ» թերթը գրում է. «Այսօր՝ սեպտեմբերի 23-ին, Սահմանադրական դատարանում տեղի կունենա աշխատակարգային նիստ, որի օրակարգում է նաեւ Սահմանադրական դատարանի նախագահի ու փոխնախագահի ընտրության հարցը: ՍԴ 9 անդամներից յուրաքանչյուրը կարող է ե՛ւ ինքնառաջադրվել, ե՛ւ առաջադրել այլ թեկնածուի: Այս պահին դեռեւս անորոշ է, թե ով կընտրվի ՍԴ նախագահ։

«Սահմանադրական դատարանի մասին» ՀՀ օրենքի 19-րդ հոդվածի համաձայն՝ Սահմանադրական դատարանի կազմից նախագահ կարող է ընտրվել այն թեկնածուն, որը ստացել է դատավորների ընդհանուր թվի ձայների երկու երրորդը, որը կազմում է 6 ձայն։ Իսկ այն դեպքում, երբ առաջադրվել է մեկ թեկնածու, ընտրվում է դատավորների ընդհանուր թվի ձայների մեծամասնությամբ՝ 5 ձայնով: Հնարավոր է, որ անսպասելի իրավիճակ առաջանա, որովհետեւ որեւէ թեկնածու կարծես թե չի ձգում վեց կամ հինգ ձայնի, քանի որ հին կազմից Հրայր Թովմասյանն ու Արեւիկ Պետրոսյանը հնարավոր է ոչ մեկին ձայն չտան եւ, առհասարակ, չմասնակցեն ընտրությանը՝ գործընթացը համարելով ոչ լեգիտիմ։ Իսկ Վահե Գրիգորյան-Արման Դիլանյան զույգը հաշտ չէ նորընտիր 3 դատավորների հետ։

Մյուս կողմից՝ Երվանդ Խունդկարյանն էլ նախագահ դառնալու նախապայմանով է գործուղվել ՍԴ։ Չի բացառվում, որ առաջին փուլով ընտրությունը չավարտվի, թույլ տան առաջադրվել եւ Խունդկարյանին ու Դիլանյանին։ Այդպիսով նաեւ դեմոկրատական ընտրության պատրանք կստեղծվի, իսկ երկրորդ փուլում թեկնածուներից քիչ ձայն ստացածը դուրս կգա մրցակցությունից, մնացողն արդեն կընտրվի 5 ձայնով։ Իսկ եթե երկրորդ փուլում էլ չհաջողվի նախագահ ընտրել, ապա, ըստ օրենքի, 10 օր անց նոր ընտրություն կկայանա»:
