Վերահսկողությունը՝ մեկ համապարփակ օրենքի շրջանակներում

Վարչապետի աշխատակազմը հանրային քննարկման է ներկայացրել «Տրանսպորտի բնագավառում պետական վերահսկողության մասին» օրենքի նախագիծը: Նշվում է, որ այս օրենքի նախագծի մշակումը պայմանավորված է տրանսպորտի վերահսկողության ոլորտում իրավական կարգավորումների հստակեցման, պարզեցման և վերահսկողության արդյունավետության բարձրացման հրամայականով: Օրենքի նախագծով սահմանվում են տրանսպորտի բնագավառում պետական վերահսկողության հիմնական սկզբունքները, առանձնահատկությունները, պետական վերահսկողություն իրականացնող անձանց իրավունքները, պարտականությունները և պատասխանատվությունը, ինչպես նաև պետական վերահսկողության հետ կապված այլ հարաբերություններ:

Օրենքի ընդունումը կնպաստի քաղաքաշինության, տեխնիկական և հրդեհային անվտանգության տեսչական մարմնի գործունեության արդյունավետության բարձրացմանը, ՀՀ-ում տրանսպորտային անվտանգության, ինչպես նաև անընդմեջ սահմանային վերահսկողության ապահովմանը: Նշվում է, որ ներկայումս տրանսպորտի բնագավառի վերահսկողության մասով հստակ և համապարփակ կարգավորումներ Հայաստանի Հանրապետությունում առկա չեն:

Որոշակի լիազորություններ և գործառույթներ սահմանված են տարբեր օրենքներում, այդ թվում՝ վարչական իրավախախտումների վերաբերյալ օրենսգրքում: Սակայն առկա կարգավորումները չեն համապատասխանում ամբողջապես ոլորտում իրականացվող քաղաքականությանը և տեսչական մարմնի կանոնադրությանը: Պատշաճ կերպով հնարավոր չէ իրականացնել, օրինակ՝ ոչ կանոնավոր ուղևորափոխադրումների, մարդատար-տաքսի ավտոմոբիլներով ուղևորների փոխադրումների, ավտոկայարանների վերահսկողությունը, տեսչական մարմնի ծառայողները չունեն նաև բավարար լիազորություններ վերոնշյալ և այլ վերահսկողական գործառույթներն իրականացնելու համար:

Բացի այդ, անվտանգության նկատառումներից ելնելով՝ տրանսպորտի բնագավառում անհրաժեշտ է ապահովել պատշաճ անընդմեջ սահմանային վերահսկողություն: Նախագծով առաջարկվում է տրանսպորտի բնագավառի վերահսկողությունն իրականացնել մեկ համապարփակ օրենքի իրավական կարգավորումների համապատասխան՝ ապահովելով տրանսպորտի բնագավառի վերահսկողության առավել արդյունավետ, անխափան և բնականոն գործունեությունը:
