Հարգելի ծնողներ

Սույն թվականի սեպտեմբերի 10-ի իմ դիմումի հիման վրա ՎԴ/6107/05/20 վարչական գործով՝ վարչական դատարանը 5 դատավորի կազմով հաստատված է համարել, որ Կորոնավիրուսային հիվանդության /COVID-19/ պայմաններում հանրակրթական ուսումնական հաստատություններում գործունեության կազմակերպման ուղեցույցը (այսուհետ՝ ՈՒՂԵՑՈՒՅՑ) նորմատիվ իրավական ակտ չէ և ենթակա չէ կիրառման և կատարաման։

Ինչից հետևում է, որ սկսած սեպտեմբեր 15-ից դպրոցներում կիրառվող սահմանափակումները ապօրինի են և ոչ ոք իրավասու չէ այդ կարգը երեխաներին և ուսուցիչներին պարտադրել։

Ստորև ներկայացնում եմ դատարանի որոշման հատվածը՝ ամբողջությամբ․

Տվյալ դեպքում, դիմումատուն վիճարկում է «Հայաստանի Հանրապետությունում արտակարգ դրություն հայտարարելու մասին» ՀՀ կառավարության 16.03.2020թ.-ի թիվ 298-Ն որոշումը, ՀՀ պարետի 18.08.2020թ.-ի թիվ 253 որոշումը և Կորոնավիրուսային հիվանդության (COVID-19) պայմաններում հանրակրթական ուսումնական հաստատություններում գործունեության կազմակերպման ուղեցույցի 17-րդ կետը:

«Նորմատիվ իրավական ակտերի մասին» ՀՀ օրենքի 2-րդ հոդվածի 1-ին մասի 1-ին կետի համաձայն՝ նորմատիվ իրավական ակտը Հայաստանի Հանրապետության ժողովրդի, ինչպես նաև Սահմանադրությամբ նախատեսված մարմինների կամ պաշտոնատար անձանց ընդունած գրավոր իրավական ակտ է, որը պարունակում է վարքագծի պարտադիր կանոններ անորոշ թվով անձանց համար:

Նշված կարգավորման լույսի ներքո նախ, ուսումնասիրելով դիմումին կից որրպես վիճարկվող նորմատիվ իրավական ակտ ներկայացված՝ «Կորոնավիրուսային հիվանդության (COVID-19) պայմաններում հանրակրթական ուսումնական հաստատություններում գործունեության կազմակերպման ուղեցույց» վերտառությամբ փաստաթղթի տեքստը, ինչպես նաև ՀՀ կրթության, գիտության, մշակույթի և սպորտի նախարարության պաշտոնական կայքում տեղադրված՝ նույն ուղեցույցի տեքստը՝ Դատարանն արձանագրում է, որ այն չունի նորմատիվ իրավական ակտի ձևակերպում, մասնավորապես, դրանում նշված չէ ընդունող մարմնի կամ պաշտոնատար անձի անվանումը, ընդունման տարին, ամիսը, ամսաթիվը, հերթական (գրանցման) համարը և նշում դրա բնույթի մասին, տեսակի անվանումը, ստորագրող պաշտոնատար անձի (անձանց) պաշտոնը, անվան սկզբնատառը, ազգանունը, ստորագրությունը (ստորագրությունները), ստորագրման տարին, ամիսը, ամսաթիվը և վայրը:

Ոչ դիմումին կից ներկայացված տեքստում և ոչ էլ ՀՀ կրթության, գիտության, մշակույթի և սպորտի նախարարության պաշտոնական կայքում տեղադրված՝ նույն ուղեցույցի տեքստում նշված չէ, որ տվյալ ուղեցույցը հաստատված է որևէ նորմատիվ իրավական ակտով: Ընդ որում, Հայաստանի իրավական տեղեկատվական համակարգում ևս նման նորմատիվ իրավական ակտ հրապարակված չէ։
