Վարորդական իրավունք ստանալու համար կաշառք տալու դեպքով երկու անձի մեղադրանք է առաջադրվել
SOCIETYՀՀ քննչական կոմիտեի Տավուշի մարզային քննչական վարչության Դիլիջանի քննչական բաժնում ավարտվել է կաշառք տալու, կաշառք տալուն դրդելու ու կաշառքի միջնորդության փորձ կատարելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Այս մասին տեղեկանում ենք ՀՀ քննչական կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժնից:
Մինչդատական վարույթում ձեռք բերված տվյալների համաձայն՝ 18-ամյա երիտասարդը 2020թ. վարորդական իրավունքի վկայական ստանալու համար մասնակցել է գործնական քննության և ստացել բացասական գնահատական: Վերջինս պատահաբար ծանոթացել է 49-ամյա համաքաղաքացու հետ, ում հայտնել է վարորդական իրավունքի վկայական ձեռք բերելու իր ցանկության մասին` նշելով, որ պատրաստվում է կրկին մասնակցել գործնական քննության: Համաքաղաքացին պատրաստակամություն է հայտնել օգնել երիտասարդին:
2020թ. մայիսի 21-ին Իջևան քաղաքում 18-ամյա երիտասարդը մասնակցել է քննությանը և նույնպես բացասական գնահատվել, որից հետո պաշտոնատար անձին միջնորդի միջոցով կաշառք տալու դիտավորությամբ, 49-ամյա համաքաղաքացու դրդչությամբ վերջինիս տվել է գումար` ՀՀ ճանապարհային ոստիկանության քննական բաժանմունքի տեսուչին որպես կաշառք փոխանցելու և նրա կողմից քննության արդյունքը փոխելու և վարորդական իրավունքի վկայական տալու համար:
49-ամյա տղամարդը փորձել է գումարը տալ ոստիկանության տեսուչին, սակայն վերջինս չի վերցրել առաջարկված գումարը և հրաժարվել է իր պաշտոնեական դիրքն օգտագործելով երիտասարդի օգտին որևէ գործողություն կատարել:
Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 49-ամյա տղամարդուն մեղադրանք է առաջադրվել` ՀՀ քրեական օրենսգրքի 38-312-րդ հոդվածի (կաշառք տալուն դրդելու) 1-ին մասով և ՀՀ քրեական օրենսգրքի 34-313-րդ (կաշառքի միջնորդության փորձ) հոդվածի 1-ին մասով, իսկ 18-ամյա երիտասարդին՝ ՀՀ քրեական օրենսգրքի 312-րդ (կաշառք տալը) հոդվածի 1-ին մասով: Նրանց նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն՝ չհեռանալու մասին:
Նախաքննությունն ավարտվել է և քրեական գործը` մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
