ՏՄՊՊՀ-ն տուգանք է կիրառել «Ալեքս Հոլդինգ»-ի նկատմամբ՝ շաքարավազի շուկայում գերիշխող դիրքը չարաշահելու համար
ECONOMICSՇաքարավազի շուկայում իրականացրած ուսումնասիրության շրջանակում մի շարք տնտեսվարող սուբյեկտների նկատմամբ հարուցված վարչական վարույթի արդյունքում ՀՀ տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովի որոշմամբ:
շուրջ 24.7 մլն դրամի չափով տուգանք է կիրառվել «Ալեքս Հոլդինգ» ՍՊԸ-ի նկատմամբ գերիշխող դիրքի չարաշահման համար:
Վարույթի քննությամբ պարզվել է, որ հանձնաժողովի կողմից դիտարկված ողջ ժամանակահատվածում՝ 2018 թվականի հունվարից մինչև 2020 թվականի մարտ ամիսը, «Ալեքս Հոլդինգ» ընկերությունը չարաշահել է ապրանքային շուկայում ունեցած գերիշխող դիրքը, ինչը դրսևորվել է երեք խախտման հատկանիշներով՝ գների չհիմնավորված իջեցում, խտրական պայմանների և գների կիրառում, այնպիսի պայմանների կամ վարքագծի սահմանում կամ կիրառում, որոնք հանգեցնում են կամ կարող են հանգեցնել տնտեսական մրցակցության սահմանափակմանը, կանխմանը կամ արգելմանը։ Մասնավորապես, «Ալեքս Հոլդինգ» ընկերության գործողություններն ուղղված են եղել ապրանքային շուկայում իր մասնաբաժինը պահպանելուն, այդ թվում՝ շուկայում առավել էժան շաքարավազի առկայության պարագայում ընկերությունն իր կողմից արտադրված և ներմուծված շաքարավազի գինը իջեցրել է այնպես, որ հնարավոր լինի իրացնել շաքարավազը մրցունակ գնով՝ որոշ դեպքերում կրելով վնասներ: Արդյունքում՝ այն տնտեսվարող սուբյկետների համար, որոնք ներմուծել են «Ալեքս Հոլդինգ» ընկերության կողմից իրացվող շաքարավազի գնից համեմատաբար ավելի ցածր գնով շաքարավազ, այլևս նպատակահարմար չի լինում զբաղվել այդ գործունեությամբ: Միաժամանակ, շաքարավազի իրացման գործընթացը «Ալեքս Հոլդինգ» ընկերության կողմից իրականացվում է այնպես, որ շաքարավազի խոշոր գնորդ հանդիսացող և տնտեսական կարողություններ ու հնարավորություններ ունեցող տնտեսվարող սուբյեկտների համար տնտեսապես նպատակահարմար չլինի շաքարավազի ներմուծումն իրականացնել ինքնուրույն։
Հանձնաժողովի որոշմամբ «Ալեքս Հոլդինգ» ՍՊԸ-ին հանձնարարվել է որոշումն ուժի մեջ մտնելուց հետո 1-ամսյա ժամկետում վերացնել օրենքի խախտումը՝ շաքարավազի իրացման պայմանները և գնային քաղաքականությունը համապատասխանեցնել օրենքին՝ սահմանելով նաև շաքարավազի իրացման հստակ, օբյեկտիվ և ոչ խտրական պայմաներ:
