ԲՈԿ-ի նախագահի 2020 թվականի հուլիսի 9-ի կայացված 103Ա որոշմամբ հարուցվել էր վարչական վարույթ, և հուլիսի 17-ի 107Ա հրամանով որոշում էր կայացվել անվավեր ճանաչել 2015 թվականի փետրվարի 17-ի 5Ա-վ2 հրամանով Դիանա Գալոյանին Ը.00.06-միջազգային տնտեսագիտություն մասնագիտության տնտեսագիտության դոկտորի գիտական աստիճան շնորհելու մասին որոշումը։

Դրան ի պատասխան՝ տիկին Դիանա Գալոյանի կողմից ներկայացվել էին վարչական բողոքներ, և նախարար Արայիկ Հարությունյանի որոշմամբ հարուցվել է վարչական վարույթ։

Կարևոր է արձանագրել, որ բողոքաբերի բոլոր փաստարկներն ուղղված են եղել ընթացակարգային հարցերին` առանց գրագողության բուն փաստերին անդրադառնալու: Այնուամենայնիվ, ընթացակարգային խախտումների վերաբերյալ տիկին Գալոյանի փաստարկները նույնպես անհիմն են:

Վարույթի շրջանակներում հուլիսի 31-ին՝ ժամը 12։00-ին, ԲՈԿ-ի նախագահ Սմբատ Գոգյանը հրավիրվել էր ԿԳՄՍՆ՝ ԲՈԿ-ի փաստարկները ներկայացնելու:

Նիստին ներկա էին վարույթն իրականացնող ԿԳՄՍ նախարարության երեք ներկայացուցիչները, տիկին Գալոյանն իր փաստաբանի հետ, ինչպես նաև Սմբատ Գոգյանն ու այս վարույթի շրջանակներում ԲՈԿ-ի շահերը ներկայացնող փաստաբան Սայադ Բադալյանը: Վարույթն իրականացնողները չթույլատրեցին, որ Սայադ Բադալյանը մասնակցի նիստին՝ Սմբատ Գոգյանին հորդորելով օգտվել ԲՈԿ-ի աշխատողների կամ ԿԳՄՍՆ իրավաբանական վարչության աջակցությունից:

Նշենք, որ ԲՈԿ-ը չունի իրավաբան, իսկ ԿԳՄՍՆ իրավաբանական վարչությունից հուլիսի 22-ին ելք արված և նախարարի կողմից հուլիսի 27-ին ստորագրված գրությամբ ԲՈԿ-ին հայտնել են, որ ԲՈԿ-ը սխալ է վարվել: Ստացվում է, որ վարույթը վերահսկող, որոշում կայացնողը (ԿԳՄՍ նախարարը) և ԿԳՄՍՆ իրավաբանական վարչությունը (ԲՈԿ-ի շահերը ներկայացնելու պարտավորվող մարմինը) ի սկզբանե արտահայտել են վարույթի վերաբերյալ իրենց դիրքորոշումը, իսկ վարույթն իրականացնողները չեն թույլատրում, որպեսզի ԲՈԿ-ը ներկայանա սեփական փաստաբանով՝ փոխարենը հորդորելով շահերի պաշտպանության համար դիմել հենց ԿԳՄՍՆ իրավաբանական վարչությանը։

ԲՈԿ-ի շահերի պրոֆեսիոնալ պաշտպանության անհնարինության պատճառով ԲՈԿ-ի նախագահ Սմբատ Գոգյանը հրաժարվել է մասնակցել լսումների ընթացքին և Սայադ Բադալյանի հետ լքել է լսումները՝ հուլիսի 31-ին իր գրավոր դիրքորոշումն ուղարկելով վարույթն իրականացնողներին: Հավելենք, որ վարույթն իրականացնողներից մեկը նույնպես հուլիսի 17-ին ՀՊՏՀ ռեկտորի ընտրությունների ընթացքում և «Հրապարակին» տված  հարցազրույցում նշել է, որ ԲՈԿ-ը սխալ է վարվում:

Այս գործի շրջանակներում ակնկալում ենք հրապարակային և բաց քննարկումներ, ինչը հնարավորություն կտա Հայաստանի Հանրապետության բարձրագույն կրթության և գիտության բնագավառի համար հայեցակարգային այս հարցում գտնելու ճիշտ լուծում, լուծում, որը կանխորոշելու է մոտակա տարիներին ՀՀ-ում բարձրագույն կրթության կառավարման մասնագիտական ու հատկապես բարոյական տեսանկյունը: Ահա ԲՈԿ-ի ներկայացրած դիրքորոշումը:
