Ռուսաստանում սկսել են կալանել հայկական համարանիշներով ավտոմեքենաները
INTERNATIONAL NEWSՄինչ վերջերս ՌԴ տարածքում որէեւ հարց չի առաջացել՝ կապված Հայաստանում գրանցված համարանիշներով ավտոմեքենաներ վարելու հետ, սակայն վերջին շրջանում հարցեր են ուղղում եւ՛ մաքսային մարմինները, եւ՛ պետավտոտեսչությունը, գրում է zr.ru-ն «Հին հայերը» հոդվածում:
Կարելի է ենթադրել, որ խնդիրն առաջացել է ոչ միայն սահմանին մաքսատուրքերը չվճարելու , այլ նաեւ ճանապարհային տեսախցիկների կողմի խախտման արձանագրման դեպքում նման ավտոմեքենաների սեփականատերերի անպատժելիության պատճառով:
2019-ի նոյեմբերին ՌԴ նախկին վարչապետ Դմիտրի Մեդվեդեւը ՆԳՆ-ին, տրանսպորտի նախարարությանը, արդարադատության նախարարությանը, ԴՄԾ-ին եւ ԱԴԾ-ին հանձնարարել էր խախտողների դեմ պայքարի մեթոդներ մշակել: Սակայն, կարծես, հանձնարարականը չէր իրականացվել, իսկ դրա փոխարեն որոշվել էր արգելք սահմանել:
ՌԴ օրենքներում չկան հստակ բացատրություններ, թե օրինական է արդյոք արտասահմանյան համարանիշներով ավտոմեքենա վարելը՝ նշվում է հոդվածում:
Այդ ավտոմեքենաների սեփականատերերին կարող են տուգանել 500 ռուբլիով: Սակայն դա հակասում է «ՌԴ տարածքում ավտոտրանսպորտային միջոցների գրանցման մասին» 12.08.1994 (խմբ. 26.04.2020) ՌԴ կառավարության որոշմանը:
Այսինքն՝ ԵԱՏՄ երկրների ավտոմեքենաները կարող են ազատ տեղաշարժվել ՌԴ տարածքում: Իսկ մաքսային օրենդրության մեջ չկա ԵԱՏՄ տարածքում քաղաքացիների կողմից ԵԱՏՄ երկրում ձեռքբերված տրանսպորտի օգտագործման արգելք:
Այնուամենայնիվ, մաքսային ծառայությունը մեղադրում է ՌԴ քաղաքացի հանդիսացող սեփականատերերին մաքսային օրենդրության խախտման մեջ:
Դա տեղի է ունեցել 2020 թվականի սկզբին «ԵԱՏՄ-ին Հայաստանի միացման մասին պայմանագրի» հայտնվելու պատճառով , որում նշվում է, որ Հայաստանում գրանցված ավտոմեքենա վարելու իրավունք ունի միայն ՀՀ քաղաքացին կամ անձը, որը մշտական բնակվում է ՀՀ տարածքում: Ընդ որում, «մշտական բնակություն» տերմինի նշանակությունը չկա ՌԴ որեւէ օրենքում:
Այժմ ավտոմեքենաները սկսել են կալանել: Կուրգան քաղաքում արդեն կալանվել է 4 ավտոմեքենա: Նման գործողություններ են իրականացվում նաեւ Ուրալում, Խանտի-Մանսիյսկում, Կուրգանում, Տյումենում, Նիժնեվարտովսկում, Չելյաբինսկում:
Ստավրոպոլի պետավտոստեսչությունը պատմել է ՌԴ տարածքում հայկական համարանիշներով ավտոմեքենաներ վարելու կանոնների մասին: 10 օրվա ընթացքում նման ավտոմեքենաների սեփականատերերը պետք է դրանք գրանցեն ՌԴ-ում, հաղորդում է Bloknot-ը:
«Ճանապարհային երթեւեկության մասին» 10.12.1995-ի №196-ՖЗ Դաշնային օրենքի 15-րդ հոդվածի 3-րդ մասի համաձայն՝ տրանսպորտային միջոցը կարելի է վարել, եթե այն պետգրանցում է ստացել:
Պետգրանցում անհրաժեշտ է ստանալ ներկրման պահից 10 օրվա ընթացքում:
Եթե ավտոմեքենայի սեփականատերը ՌԴ քաղաքացի է եւ ավտոմեքենան ներկրում է ՌԴ տարածք, ապա գրանցվելու համար ունի 10 օր: Նա պետք է դիմի պետավտոտեսչության ցանկացած բաժանմունք՝ ներկայացնելով տեխանձնագիր, ապահովագրական պոլիս, վարորդական իրավունք եւ առքուվաճառքի պայմանագիր:
Եթե ավտոմեքենայի սեփականատերը չգրանցի ավտոմեքենան, ապա կարող է տուգանվել 500-800 ռուբլիով: Կրկնակի խախտման համար տուգանքը կլինի 5000 ռուբլի, ինչպես նաեւ նախատեսված է ազատազրկում 1-3 ամիս ժամկետով:
