Արմեն Սարգսյանը օրենքը չի ուղարկի Սահմանադրական դատարան
POLITICS«Հրապարակ» թերթը գրում է. «Նախագահ Արմեն Սարգսյանը հունիսի 30-ին ԱԺ նախագահ Արարատ Միրզոյանին հայտնել էր, որ չի ստորագրելու «Սահմանադրական դատարանի մասին» սահմանադրական օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին օրենքը։
ՀՀ Սահմանադրության 129-րդ հոդվածի 1-ին կետի համաձայն՝ Ազգային ժողովի ընդունած օրենքը հանրապետության նախագահն ստորագրում եւ հրապարակում է քսանմեկօրյա ժամկետում կամ նույն ժամկետում դիմում է Սահմանադրական դատարան՝ Սահմանադրությանն օրենքի համապատասխանությունը որոշելու հարցով:
Նույն հոդվածի 2-րդ կետով սահմանվում է, որ եթե Սահմանադրական դատարանը որոշում է, որ օրենքը համապատասխանում է Սահմանադրությանը, ապա հանրապետության նախագահը հնգօրյա ժամկետում ստորագրում եւ հրապարակում է օրենքը: Երրորդ կետով էլ ամրագրված է․ «Եթե հանրապետության նախագահը չի կատարում սույն հոդվածով սահմանված պահանջները, ապա Ազգային ժողովի նախագահը հնգօրյա ժամկետում ստորագրում եւ հրապարակում է օրենքը»։
Ստացվում է՝ Արմեն Սարգսյանն այս վիճելի օրենքի ստորագրման քաղաքական պատասխանատվությունը թողել է Արարատ Միրզոյանի վրա։ Այսինքն, եթե 21-օրյա ժամկետում նախագահը չի ստորագրում, ինչի մասին արդեն հայտնել է ԱԺ նախագահին, եւ չի էլ ուղարկում ՍԴ, դրանից հետո 5-օրյա ժամկետում ԱԺ նախագահն ինքն է ստորագրում եւ հրապարակում օրենքը, ինչի մասին երեկ ասել էր, որ «հաճույքով» է կատարելու։
Բայց պակաս կարեւոր չէ նախագահ Արմեն Սարգսյանի առաքելությունը, որն ուղղակի քաշվել է մի կողմ եւ թողել, որ Սահմանադրության հետ իշխանությունն ինչ ուզի, անի։ Երեկ մենք նախագահականից հետաքրքրվեցինք՝ հնարավո՞ր է չստորագրելուց բացի Արմեն Սարգսյանը որոշի, ամեն դեպքում, դիմել Սահմանադրական դատարան։ Նախագահականից, սակայն, ոչինչ չասող հերթապահ մի պատասխան տվեցին․ «Ի պատասխան Ձեր հարցմանը՝ տեղեկացնում ենք, որ «Սահմանադրական դատարանի մասին» սահմանադրական օրենքում փոփոխությունների եւ լրացումների փաթեթը հանրապետության նախագահի կողմից չստորագրելու վերաբերյալ լրացուցիչ մեկնաբանություններ չունենք»։
Մենք տեղեկացանք, սակայն, որ Արմեն Սարգսյանը մտադիր չէ Սահմանադրական դատարան դիմել եւ հարցն ինքնահոսի կթողնի՝ 21 օրը լրանալուց հետո ԱԺ նախագահը կստորագրի եւ կհրապարակի օրենքը։ Ինքն ամբողջությամբ ձեռքերը լվանում է ՍԴ-ի շուրջ ծավալվող եւ շատերի կողմից հակասահմանադրական որակվող ռիսկային գործընթացից։ Այս հարցում Արմեն Սարգսյանը մի կողմից զգուշավորություն է ցուցաբերում եւ ամեն ինչ անում, որ չարժանանա Նիկոլ Փաշինյանի զայրույթին, մյուս կողմից հեռատեսություն է ցուցաբերում՝ ապագայում ապահովագրելով իրեն պատասխանատվության առջեւ կանգնելուց։
Թեպետ նա կարող էր պասիվ դիտորդի դեր ստանձնելու փոխարեն կոնկրետ քայլեր ձեռնարկել եւ դեռ սկզբից այս խորհրդարանի ընդունած վիճելի օրենքներն ուղարկել Սահմանադրական դատարան՝ դրանց սահմանադրականությունը ստուգելու։ Բայց Արմեն Սարգսյանը դա չարեց՝ թույլ տալով, որ իր գործողությունները տարբեր իրավաբանների կողմից որակվեն որպես «հանցավոր անգործություն» եւ սահմանադրական հեղաշրջմանը չխոչընդոտելով՝ դրանով իսկ անօրինական գործընթացին նպաստելու ակնհայտ գործողություններ»:
