Նոր նախագիծ. առաջարկվում է միջինը 4 անգամ ավելացնել դատարաններ դիմելու պետական տուրքի չափը
SOCIETYՀՀ արդարադատության նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «Պետական տուրքի մասին» ՀՀ օրենքում՝ ավելացնելով դատարան դիմելու պետական տուրքի չափը: Համապատասխան օրենքի նախագիծը տեղադրված է e-draft.am տեղեկատվական հարթակում:
Նախագծով առաջարկվում է պետական տուրքի գործող դրույքաչափերը ավելացնել միջինում մինչև 4 անգամ։ Արդյունքում դրամական պահանջի դեպքում Տուրքի նվազագույն արժեքը կազմում է 6,000 դրամ, որն էլ իր հերթին կազմում է նվազագույն սպառողական զամբյուղի մոտավորապես 9.77 %-ը:
Միաժամանակ, նույն սկզբունքով առաջարկվում է վերանայել նաև դրամական պահանջներով հայցադիմումների, դիմումների Տուրքի տոկոսադրույքները, ինչպես նաև Տուրքի գանձման այլ դեպքերը։
Նախագծի ընդունմամբ ակնկալվում է համապատասխանեցնել դատարան տրվող հայցադիմումների, դիմումների, դատարանի դատական ակտերի դեմ վերաքննիչ և վճռաբեկ բողոքների համար վճարվող պետտուրքի դրույքաչափերը ներկայումս հաստատված սոցիալ-տնտեսական ցուցանիշներին։
Ըստ նախագծի հիմնավորման՝ դատարան տրվող հայցադիմումների, դիմումների, դատարանի դատական ակտերի դեմ վերաքննիչ և վճռաբեկ բողոքների համար պետտուրքի դրույքաչափերը փոփոխության չեն ենթարկվել «Պետական տուրքի մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» 1999 թ.-ի հոկտեմբերի 12-ի ՀՕ-4 օրենքի ընդունումից ի վեր, իսկ գործող դրույքաչափերը չեն արտացոլում երկրի սոցիալ-տնտեսական հարաբերությունների առկա իրավիճակը:
Հիմնավորման համաձայն՝ օրենքի վերջին փոփոխությունից ի վեր 4,89 անգամ աճել է մեկ շնչին ընկնող համախառն ներքին արդյունքը, միջին ամսական աշխատավարձն աճել է 8,04 անգամ, նվազագույն սպառողական զամբյուղի արժեքն աճել է 5,2 անգամ, աճել է նաև սպառողական գների ինդեքսը: Արդյունքում, նշված սոցիալ-տնտեսական ցուցանիշները 2000թ.-ից մինչև 2020 թ.-ի առաջին եռամսյակը աճել են միջինում 4.4 անգամ։
Մյուս կողմից, Ֆինանսների նախարարության կողմից տրամադրված տեղեկատվության համաձայն` նախորդ երկու տարիների վիճակագրությունը ցույց է տալիս, որ արդարադատության իրականացման ծախսերը գերազանցել են դատարանների կողմից հավաքագրված պետական տուրքի գումարները մինչև 4 և ավելի անգամ: Արդյունքում, 2018թ.-ից մինչև 2020թ.-ի առաջին եռմասյակի տվյալներով, «ՀՀ պետական բյուջեի մասին» օրենքներով ՀՀ դատարանների բնականոն գործունեությունն ապահովելու նպատակով ՀՀ դատական դեպարտամենտին հատկացված և փաստացի ծախսված գումարների տարբերությունը միջինում կազմել է մոտ 4 անգամ:
