Սահմանադրական դատարանի արդեն նախկին անդամներն իրավունք չունեն մուտք գործելու ՍԴ վարչական շենք. ՀՀ ոստիկանություն
POLITICSՈստիկանությունը պարզաբանել է ՍԴ դատավոր Հրանտ Նազարյանի հետ կապված միջադեպը: Նշենք, որ այսօր ՍԴ դատավորը ցանկացել է մտնել ՍԴ շենք, սակայն նրան ոստիկանները թույլ չեն տվել:
Պարզաբանման մեջ, մասնավորապես, ասվում է.
«22.06.2020 թվականին ՀՀ Ազգային Ժողովի կողմից ընդունված եւ 26. 06. 2020 թվականին ուժի մեջ մտած ՀՀ Սահմանադրության 213-րդ հոդվածում կատարված փոփոխությունների հիման վրա՝ մինչեւ Սահմանադրության 7-րդ գլխի ուժի մեջ մտնելը նշանակված եւ Սահմանադրական դատարանի անդամի կամ դատավորի պաշտոնում ընդհանուր տեւողությամբ ոչ պակաս, քան 12 տարի պաշտոնավարած Սահմանադրական դատարանի անդամի (դատավորի) լիազորությունների ժամկետը համարվում է ավարտված, եւ պաշտոնավարումը դադարում է:
Սահմանադրական նորմերի անմիջական գործողության տրամաբանությունից ելնելով` արձանագրում ենք, որ եթե լրացել է Սահմանադրական դատարանի անդամի կամ դատավորի` այդ պաշտոնում պաշտոնավարման ընդհանուր տեւողությամբ ոչ պակաս, քան 12 տարին, ապա Սահմանադրական դատարանի անդամի (դատավորի) լիազորությունները համարվում են դադարած:
Նորմի համակարգային վերլուծությունը թույլ է տալիս արձանագրելու, որ սահմանադրական դատարանի արդեն նախկին անդամներն իրավունք չունեն մուտք գործելու Սահմանադրական դատարանի վարչական շենք: Սահմանադրական դատարանի շենքում անցագրային ռեժիմի հետ կապված հարցերը կարգավորված են սահմանադրական դատարանի աշխատակարգի 3-րդ հավելվածով»։
