Ռոբերտ Քոչարյանի փաստաբանները քննարկում են այսօր դիմումը ՍԴ-ից հետ վերցնելու հարցը. «Փաստինֆո»
BLOG«Փաստինֆո»-ի տեղեկություններով՝ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանական խումբը քննարկում է Ռոբերտ Քոչարյանի կողմից ՍԴ ներկայացված դիմումը հետ վերցնելու հարցը։ Բացառված չէ, որ հենց այսօր պաշտպանական խումբը հայտարարի այդ մասին։
Հիշեցնենք՝ Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի և Ռոբերտ Քոչարյանի դիմումների հիման վրա քննության ընդունված գործով ՀՀ Սահմանադրական դատարանը 2019 թվականի հուլիսի 18-ին կասեցրել էր վարույթը ու դիմել ՄԻԵԴ, Վենետիկի հանձնաժողով՝ խնդրահարույց հարցերի վերաբերյալ խորհրդատվական կարծիք ստանալու համար։
2020 թվականի մայիսի 29-ին հրապարակվեց ՄԻԵԴ-ի, իսկ հունիսի 18-ին Վենետիկի հանձնաժողովի եզրակացությունը, հետեւապես կասեցման հիմքը վերացվել էր եւ այն ենթակա էր վերսկսման։
ՍԴ-ն որոշում էր կայացրել գործերը միացնելու մասին և նիստի օր էր նշանակել հուլիսի 7-ին։
Այս ընթացքում ԱԺ-ն ընդունել է Սահմանադրական փոփոխությունների վերաբերյալ նախագիծը, որով նախատեսվում է դադարեցնել, ընդհանուր առմամբ 12 տարի պաշտոնավարած դատավորների լիազորությունները, իսկ Հրայր Թովմասյանը կպաշտոնավարի որպես դատավոր։ Սահմանադրության փոփոխությունների փաթեթն ընդունվել է Սահմանադրության խախտմամբ՝ առանց ՍԴ եզրակացությունն ստանալու, ավելին՝ քաղհասարակությունը եւս մասնակից չի դարձվել մայր օրենքի մեջ նախատեսված փոփոխություններին։
Փորձագետները, ընդդիմադիր ուժերը խորհրդարանական մեծամասնության այս քայլը գնահատել են որպես սահմանադրական հեղաշրջում։
ԱԺ «Բարգավաճ Հայաստան» խմբակցությունը ստորագրահավաք էր կազմակերպել՝ ՍԴ դիմելու համար, սակայն միայն խմբակցության ձայները բավարար չեն, անհրաժեշտ էր եւս երկու պատգամավոր, որ միանար, «Լուսավոր Հայաստան» խմբակցությունն էլ հայտարարել էր, թե կդիմի ՍԴ, բայց հուլիսի 7-ից հետո, երբ կավարտվի Քոչարյանի դիմումի հիման վրա ՍԴ-ում գործի քննությունը։
