«Ժողովուրդ». Ե՞րբ եւ ինչպե՞ս կկատարվի ՍԴ դատավորների ընտրությունը

«Ժողովուրդ» օրաթերթը գրում է․ ««Սահմանադրական դատարանի նախագահի պաշտոնում Հրայր Թովմասյանի պաշտոնավարման վերջին շաբաթն է։ Այս ուրբաթ Հրայր Թովմասյանն օրենքի ուժով պետք է ազատի նախագահի աշխատասենյակը, իսկ ՍԴ անդամներ Ալվինա Գյուլումյանը, Ֆելիքս Թոխյանը եւ Հրանտ Նազարյանը կլքեն Սահմանադրական դատարանը»,- երեկ այս մասին հայտարարել է ՀՀ արդարադատության նախարար Ռուստամ Բադասյանը: Այս փոփոխություններով Սահմանադրական դատարանում թափուր է մնալու 3 դատավորի պաշտոն, իսկ նախագահի պաշտոնը ժամանակավորապես մինչեւ ամբողջ կազմը համալրելը եւ այդ նոր կազմից նոր նախագահ ընտրելը կզբաղեցնի տարիքով ավագ դատավորը՝ Աշոտ Խաչատրյանը։ Իսկ ի՞նչ է սպասվում դատավորների թափուր տեղերի առկայության դեպքում: ԱԺ նախագահի կողմից օրենքը հրապարակելուց՝ Սահմանադրության 7-րդ գլխի 3-րդ մասի՝ ուժի մեջ մտնելուց հետո Սահմանադրական դատարանի թափուր տեղերի համար առաջադրումները կկատարեն հաջորդաբար կառավարությունը, ՀՀ նախագահը եւ Դատավորների ընդհանուր ժողովը։ Իսկ «Սահմանադրական դատարանի մասին» օրենքի համաձայն՝ առաջադրումները պետք է կատարվեն դատավորի լիազորությունները դադարելու կամ դադարեցվելուց ոչ ուշ, քան մեկամսյա ժամկետում: Իսկ նախագահ Արմեն Սարգսյանի կողմից էլ հունիսի 24-ին ստորագրված եւ մինչ այդ Ազգային ժողովի կողմից ընդունված «ԱԺ կանոնակարգ» օրենքի փոփոխություններով էլ՝ բոլոր երեք թափուր տեղերի համար թեկնածուների քվեարկությունները տեղի կունենան նույն օրը գաղտնի քվեարկությամբ, պատգամավորների ընդհանուր թվի ձայների առնվազն երեք հինգերորդով: Բայց հիմա բավականին ուշագրավ իրավիճակ է ստեղծվել. ե՞րբ եւ ինչպե՞ս կատարել ՍԴ դատավորների ընտրությունը խորհրդարանում, որ հնարավոր լինի համապատասխան քանակով պատգամավորների մասնակցությունը ապահովել: Նշենք, որ իշխող «Իմ քայլը» խմբակցությանը անհրաժեշտ կլինի ընդհանուր ձայների երեք հինգերորդի` նվազագույնը 79 պատգամավորի կողմ ձայներ, որպեսզի ՍԴ երեք անդամներն էլ ընտրվեն, եւ կազմը համալրվի: Բանն այն է, որ կորոնավիրուսը հասել է Ազգային ժողով. երեկ հայտնի դարձավ, որ կորոնավիրուսով են վարակվել նաեւ «Իմ քայլը» խմբակցության տասնյակից ավել պատգամավորները, իսկ մինչ այդ էլ հայտնի էր դարձել ԱԺ փոխնախագահ Վահե Էնֆիաջյանի վարակակիր լինելու մասին: Եվ խորհրդարանում հիմա կան մեկուսացած պատգամավորներ բոլոր խմբակցություններում: Ինչպես հայտի է, հուլիսի 7-ին Սահմանադրական դատարանը պետք է քննի Ռոբերտ Քոչարյանի մեղադրանքում առկա հոդվածի սահմանադրականության հարցը, եւ իշխանությունները ցանկանում են արագացնել այդ գործընթացը, որպեսզի մինչ այդ հարցի քննությունը լինի նոր կազմ: Եվ հիմա այս իրավիճակում, երբ կորոնավիրուսը հասավ խորհրդարան, իշխանությունները դեռ չգիտեն՝ ինչպես անել, երբ կազմակերպել ՍԴ նոր անդամների ընտրությունը, որպեսզի չկանգնեն փաստի առջեւ»:
