Գագիկ Ծառուկյանին առնչվող փաստաթղթերը հրապարակայնացնելու առիթով ՀՀ դատախազությունը քրեական գործ է հարուցել

Այսօր հայտնի դարձավ, որ Գագիկ Ծառուկյանին առնչվող, քառասուն տարվա վաղեմությամբ քրեական գործի մանրամասները համացանցում տարածելու փաստի առթիվ, Գագիկ Ծառուկյանի փաստաբանական խմբի անդամներ՝ փաստաբաններ Էմին Խաչատրյանի և Սմբատ Մինասյանի ՀՀ գլխավոր դատախազություն ներկայացրած հաղորդման հիման վրա քրեական գործ է հարուցվել:
Հիշեցնենք, որ 2001 թվականին ՀՀ վճռաբեկ դատարանն այդ գործով արդարացման որոշում է կայացրել, որով պարոն Ծառուկյանն արդարացվել է, իսկ համացանցում հայտնված փաստաթուղթը հրապարակման ենթակա չի եղել:
Դատախազության կողմից հարուցված գրեական գործի շրջանակներում պետք է քննություն իրականցվի, պարզվի մեղավորների շրջանակը և իրավական գնահատական տրվի արարքին Orer.am-ի հետ զրույցում նշեց Էմին Խաչատրյանը: Բացի այդ, ամենակարևորը պարզելն է նաև, թե ինչպե՞ս է այդ փաստաթուղթը, որը հրապարակման ենթակա չի եղել, հայտնվել երրորդ անձանց մոտ, և տարածվել համացանցում:
«Մեզ համար հասկանալի չէ, թե քառասուն տարվա վաղեմություն ունեցող այդ դատավճիռը ի՞նչ պայամաններում է հայտնվել համացանցում: Դա պաշտոնատար անձնանց անմիջական միջամտությա՞ն, դիտավորությա՞ն, լիազորությունները չարաշահելո՞ւ, թե՞ իշխանությունների անփութության արդյունք է: Այդ հարցերի պատասխանները ստանալու համար մենք դիմել էինք, որպեսզի քրեական գործ հարուցվի ՀՀ քր.օր. 144 հոդվածի հատկանիշներով: Այսօր մեզ հայտնի դարձավ, որ քրեական գործը հարուցվել է, որով պարոն Ծառուկյանը, անկասկած, պետք է ներգրավվի գործի քննությանը որպես տուժող, քանի որ համացանցում նրա անձնական կյանքին վերաբերող տվյալներ են հրապարակվել: Ակնկալում ենք, որ իրավապահ մարմինները կիրականացնեն բազմակողմանի, լրիվ և օբյեկտիվ քննություն, և կպարզեն, թե ո՞վ է այդ դատավճիռը տարածել համացանցում և արդյո՞ք որևէ պաշտոնատար անձ առնչություն չունի այդ փաստաթղթերը երրորդ անձի մոտ հայտնվելու գործում»,- ասաց Էմին Խաչատրյանը:
Փաստաբանը տեղեկացրեց նաև, որ, փաստորեն, իրավապահ մարմինները ևս հանգել են այն եզրակացության, որ կատարվածը Գագիկ Ծառուկյանի անձնական կյանքի հանդեպ իրականացված ոտնձգություն է: Ուստի, ներկայացված հաղորդումը իրավաչափ է, կան հանցագործության հատկանիշներ, որի մանրամասները պետք է պարզվեն հարուցված քրեական գործի քննության ժամանակ:
