Կորած նույնականացման քարտի փոխարեն ստանալ նորը՝ վճարելով ավելի քիչ գումար
SOCIETYՈստիկանությունը հանրային քննարկման է ներկայացրել նախագիծ, որով առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2008 թ. դեկտեմբերի 11-ի թիվ 1465-Ն որոշման մեջ: Նախագիծը նախապատրաստելու անհրաժեշտությունը պայմանավորված է «Ոստիկանության մասին» օրենքում 2019 թ. նոյեմբերի 14-ին կատարված փոփոխություններով, որոնց արդյունքում սահմանափակվել է ոստիկանության արտաբյուջետային հաշիվներ ունենալու հնարավորությունը՝ դրանցում առկա և հավաքագրվող դրամական միջոցները ուղղելով համապատասխան բյուջեներ։
Օրենքի 40.1-րդ հոդվածի 1-ին մասի համաձայն՝ ոստիկանության կիրառած վարչական իրավախախտումների համար գանձվող տուգանքները, ինչպես նաև ոստիկանության մատուցած, այդ թվում՝ պայմանագրային հիմունքներով ծառայությունների դիմաց վճարներն ուղղվում են պետբյուջե: Ոստիկանության՝ պայմանագրային հիմունքներով մատուցվող ծառայությունների դիմաց գանձվող վճարների չափերը սահմանում է կառավարությունը:
Նշված փոփոխությամբ պայմանավորված՝ անհրաժեշտություն է առաջացել փոփոխություններ կատարել նաև կառավարության 2008 թ. դեկտեմբերի 11-ի թիվ 1465-Ն որոշման մեջ, որով սահմանված են ՀՀ քաղաքացու ցանկությամբ առավել սեղմ ժամկետներում անձնագիր, նույնականացման քարտ, փախստականի կոնվենցիոն ճամփորդական փաստաթուղթ կամ փախստականի նույնականացման քարտ տրամադրելու (փոխանակելու), ինչպես նաև ՀՀ պետական սահմանի անցակետերում օտարերկրյա պետություններում անձնագրի վավերականության ժամկետի մասին նշում կատարելու համար գանձվող վճարների չափերը, գանձվող վճարների դիմաց վերը նշված փաստաթղթերը տրամադրելու (փոխանակելու) ժամկետները և այլն:
Նախատեսվող փոփոխությունների արդյունքում սահմանվում է՝ սեղմ ժամկետում գանձվող վճարի դիմաց ոստիկանության կողմից պայմանագրային հիմունքներով մատուցվող ծառայություններից գոյացած գումարները մուտքագրվելու են ոստիկանության համար բացված բյուջետային տարանցիկ հաշվին։ Բացի այդ, նախագծով առաջարկվում է մեկ այլ լրացում, որով սահմանվում է ՀՀ քաղաքացու կամ փախստականի կորած նույնականացման քարտի փոխարեն 5-րդ աշխատանքային օրը նոր նույնականացման քարտ տալու հնարավորություն՝ 10 000 դրամ գանձվող վճարի դիմաց:
Գործող կարգավորումներում առկա է միայն կորած նույնականացման քարտի տրամադրում մեկ աշխատանքային օրվա ընթացքում և երրորդ աշխատանքային օրը, որոնց համար սահմանված է համապատասխանաբար 40000 և 20000 դրամ գումարի վճարման պահանջ: Փոփոխությունը հնարավորություն կտա քաղաքացիներին ոչ հրատապ դեպքերում կորած նույնականացման քարտի փոխարեն ստանալ նորը՝ վճարելով ավելի քիչ գումար:
